A new report is raising serious allegations against providers of so-called “gender-affirming care,” claiming some clinics and organizations may be disguising treatments for minors under misleading medical billing codes in order to bypass insurance restrictions and state laws. The findings are fueling growing calls for accountability and federal investigation.

The World Professional Association for Transgender Health, Campaign for Southern Equality, Planned Parenthood and QueerDoc have “publicly promoted the use of non-F64 diagnosis codes” – those not intended to code gender-identity disorders – to perform “sex-denying” procedures on children, medical advocacy group Do No Harm alleges.

“By framing these practices under conventional endocrinology or other non-F64 medical diagnoses, providers, at a minimum, circumvent official coding guidelines and ethical billing standards” if not commit insurance fraud and violate state laws restricting Medicaid funding for pediatric medicalized gender transitions or the procedures themselves, the report says.

According to the report, some providers allegedly use alternative insurance codes tied to endocrine disorders or hormone deficiencies instead of gender dysphoria diagnoses in order to secure insurance coverage for puberty blockers, cross-sex hormones, and other treatments for minors. The report argues that these coding practices may violate official medical billing standards and could potentially constitute insurance fraud.

The Department of Justice is currently seeking to continue investigations into several healthcare providers, including Children’s National Hospital and QueerDoc, after lower courts blocked subpoenas issued during the investigations. Federal prosecutors argue the subpoenas are necessary to determine whether providers knowingly falsified medical records, misrepresented patient sex information, or fraudulently billed insurers for gender-related treatments.

Medical advocacy group Do No Harm also warned that the complicated nature of medical billing systems makes it easier to conceal controversial treatments under vague or unrelated diagnoses. The report points to a growing number of questionable endocrine-related diagnoses among minors as potential evidence of disguised gender-transition procedures.
