The department announced the new rule in May, claiming that the federal law that bans discrimination based on sex in a Affordable Care Act health insurance law also extends to people that are transgender. …
“Plaintiffs have demonstrated a substantial likelihood of success on the merits of their claim that HHS exceeded its statutory authority by applying the Bostock holding to Section 1557’s incorporation of Title IX in its May 2024 Rule,” [U.S. District Judge Louis] Guirola wrote, per CNN.
“HHS acted unreasonably when it relied on Bostock’s analysis in order to conflate the phrase ‘on the basis of sex’ with the phrase ‘on the basis of gender identity,'” he continued. …
Guirola also pointed to the Supreme Court’s ruling last week that overturned the “Chevron Deference” precedent, which previously required courts to defer to federal agencies when they create regulations based on ambiguous laws. …

Thank you Father for this ruling. May our courts protect our children and may states realize the wickedness of transgenderism. May those who are transgender see you as Creator and let you heal their minds. May those who are transgender find favor in public opinion and in the courts as they tell their stories of this awful procedure.
Heavenly Father, thank You for Your wise and precious counsel brought forth through the U.S. Supreme Court Judges and the clear response made known by U.S. District Judge Louis Guirola. May Your words continue to flow through the voices of our courts in every state. We see the tactic by the deceiver, to mislead with words and to continue to try and expand existing law. Thank You for each intercessor whom also exercises Your word according to Your good and perfect will. LORD, show us how to be a blessing to You and to others and keep us faithful in so doing.
