This ruling could set an interesting precedent. Let’s pray about it!

The Wisconsin Supreme Court has narrowly ruled that a near-total ban on abortion passed in the 19th century is no longer valid in light of other abortion regulations passed since then.

Wisconsin’s highest court issued a 4-3Ā decisionĀ Wednesday in the case ofĀ Josh Kaul et al. v. Joel Urmanski, et al., which centered on whether a law passed in 1849 prohibiting “the intentional destruction of an unborn child” is still in effect.

Justice Rebecca Frank Dallet, a liberal, authored the majority opinion, writing that “comprehensive legislation enacted over the last 50 years regulating in detail the ‘who, what, where, when, and how’ of abortion so thoroughly covers the entire subject of abortion that it was meant as a substitute for the 19th century near-total ban on abortion.”

By passing more recent laws like the state’s 20-week abortion ban, mandatory ultrasounds and 24-hour waiting period, Dallet contends that state lawmakers had “impliedly repealed” the 1849 law.

“That comprehensive legislation so thoroughly covers the entire subject of abortion that it was clearly meant as a substitute for the 19th century near-total ban on abortion,” she continued. “A statute may be repealed either expressly, by enacting a subsequent statute that repeals the earlier one, or by implication.”

Justice Annette Kingsland Ziegler, a conservative, authored a dissenting opinion, writing that the majority engages in “a jaw-dropping exercise of judicial will” that puts “personal preference over the constitutional roles of the three branches of our state government and upending a duly enacted law.”

“In this dangerous departure from our constitutional design, four members of the court make up and apply their own version of implied repeal, failing to hew to any semblance of traditional judicial decision-making or jurisprudence,” wrote Ziegler.

Ziegler argued that the liberal majority of the state supreme court ruled the way they did because, as part of being elected to their position, they promised to do so.

“Put bluntly, our court has no business usurping the role of the legislature, inventing legal theories on the fly in order to make four justices’ personal preference the law,” she continued.

“The Court did not send the question of abortion policy to state courts to take over where it left off. Abortion policy is for the legislature to decide.”

Wisconsin’s 1849 ban had been in effect until 1973, when the U.S. Supreme Court issued its controversialĀ Roe v. WadeĀ decision, which labeled abortion a constitutional right.

Despite the ruling, the 1849 law remained on the books. When the U.S. Supreme Court overturnedĀ RoeĀ in 2022, many argued that the ban again be enforced again.

In 2022, Wisconsin Attorney General Josh Kaul, a Democrat,Ā suedĀ to prevent the ban from again taking effect, while abortion providers in the state temporarily halted services as a precaution.

As we continue to repent fast pray and stand in the public square I think about Abraham asking God to spare Sodom and Gomorrah if there was one righteous. Gods response is comforting relief for us intercessors.

And in the case of abortion- it being on the list of one of the seven things God hates there may be a different response-more along the lines of Ez 14. Recently after a conversation with a pro-life activist standing against the END ABORTION MOVEMENT and the ā€œequal rights under the lawā€ bill just introduced June 18th in Ohio, I heard God say, ā€œYou have not TRUELY repented of shedding innocent blood until abortion is considered a criminal act.ā€ I was present at the state house when the bill was presented and was told by CCV representative ā€œwe don’t support this bill because it incriminates womenā€ which is the same stance many pro-life organization have taken. I DONT UNDERSTAND THEIR LOGIC! Here is the link to END ABORTION OHIO talking points that day.

We as believers are at a crossroad with this issue. We are divided. God wants a bride that is unified and robed in His righteousness walking in truth. Truth tells us abortion in all forms is something God hates. Murder is always murder. Ignorance is not an excuse. True repentance requires a ā€œturning away fromā€! Legislating abortion only serves to perpetuate murder. Many women do it because ā€œIt is legalā€ which provides easy access.
I have only been involved in the pro-life movement since abortion was legalized. But I remember the day when abortion clinics were being blown up. We can’t keep passing off the killing of the most innocent and vulnerable as a mistake. God clearly does not see it that way.

    Tina, after reading your comment I was reminded of this passage from Proverbs 16:
    3Commit your works to the LORD and your plans will be achieved. 4The LORD has made everything for His purpose— even the wicked for the day of disaster. 5Everyone who is proud in heart is detestable to the LORD; be assured that he will not go unpunished.…

    I am a sinner ( the very worst) who has been saved by the blood of the Lamb, He is the only One who will take away the sins of the world. I pray these who refuse to see will feel His displeasure deeply and profoundly…..Godly sorrow leads to repentance and salvation….in Christ alone. I pray the LORD will bless and reward all of our efforts and prayers for the unborn.
