At 1 p.m. local time on Jan. 6, members of Congress will gather in the chamber of the House of Representatives to observe the formal certification of Electoral College votes for president of the United States. . . .
The situation is complicated by a lack of clarity on the legal and constitutional guardrails for the process. The joint session of Congress may well result in gridlock, in which a clear winner of the race isn’t announced at all.

Based on current election results, former Vice President Joe Biden has received 306 electoral votes to Trump’s 232 votes. Meanwhile, Republicans in seven states where Biden claimed victory have sent their own sets of electoral votes to Washington, and some members of the House have indicated that they will object to Biden electors in some states. Any objection would require support from one House member and one senator to be considered, and at least one senator has left open the possibility he would join the effort. . . .
The counting of votes is primarily governed by the 12th Amendment of the Constitution and the amended Electoral Count Act.
The Constitution simply states that electors of each state have to meet, make a list of their votes, “which they shall sign and certify,” and send those to the president of the Senate, meaning Vice President Mike Pence. . . .

The Electoral Count Act of 1887, currently known as 3 U.S. Code Section 15, establishes a procedure for how the votes are counted, how to raise objections, and how to resolve disputes. First, it says that the vice president indeed presides over the proceedings. Then, it says the House and Senate leaders each designate two tellers. The VP opens the envelopes with the vote certificates and hands them to the tellers for counting. The tellers then read them out loud, count them, and hand them back to the VP to announce the results.
Then, in rather convoluted language, the law says that Congress members can object. At least one objection from each chamber is needed to trigger a separate vote by both House and Senate on the objections. If both chambers agree, the objected voters are rejected. . . .
If two sets of electors are presented for counting, the House and Senate need to separately vote on which set is legitimate and which should be rejected. . . .
The problem is, there’s a voluminous body of legal analysis arguing that the Electoral Count Act is unconstitutional. Congress has no business granting itself the authority to decide which slate of electors is the correct one and which votes should be rejected. Nor does Congress have the power to designate state governors as the final arbiters, a lineup of legislators and legal scholars have argued.
Some jurists say it’s the VP who has the sole discretion to decide which votes to count. The argument is that the framers intended for the VP to be the sole authority over the counting of the votes because the unanimous resolution attached to the Constitution said that the Senate should appoint its president “for the sole purpose of receiving, opening, and counting the votes for president.”
Moreover, before the adoption of the Electoral Count Act, it was always the VP counting the votes, sometimes despite major objections from Congress. . . .
Arizona state lawmakers and GOP electors, together with Rep. Louie Gohmert (R-Texas), have filed a federal suit asking for the court to clarify the law to the effect that the Electoral Count Act is unconstitutional and the VP’s power is paramount. . . .
University of Virginia professor John Harrison, an expert on constitutional history, says the VP doesn’t have “any constitutional power to make decisions” over which votes to count.
He argued that the law is deficient to the effect that “Congress doesn’t have the power to make the announcement [of its decisions regarding the vote count] conclusive.” . . .
“The Constitution does call for counting the votes with both houses present, so I think that setting up procedures for a count is within Congress’s power,” he told The Epoch Times via email.
The second argument is that the Constitution grants the authority to determine how electors are picked to state legislatures. As such, any disputes over which votes should be counted should be resolved by state legislatures.
The problem is, state legislatures aren’t in session and they can’t assemble in a special session without a call from the governors, who have refused to do so. Meanwhile, the legislatures have usually delegated the power to certify electors to the Governors and Secretaries of State, undermining their own authority on the matter. . . .
That would not only knock down some provisions of the Electoral Count Act, but also render electoral votes that haven’t been certified post-election by state legislatures illegitimate.
Regardless of what the courts will say, the core question is what will take place in the House chambers on Jan. 6? Will Pence refuse to follow the Electoral Count Act? Will some of the tellers dissent? If things go wrong for the Democrats, will House Speaker Nancy Pelosi (D-Calif.) try to end the session prematurely? . . .

I Ron Johnson of Iowa believe the Democrats have defiled the election process by causing Biden to win. This was wrong and illegal to give more votes to their candidate through cheating and lying. I certainly believe President Trump would have won the most votes if the election had not been rigged but had been done by an honest method. As reported in the Epoch Times on Dec 31, Vice President Mike Pence asked a federal judge to reject an effort to give him “exclusive authority” to decide which Electoral College votes should be counted during the upcoming joint session of Congress on Jan 6. It is shocking but it can be understood. The electoral fraud uncovered in the 2020 presidential election tells the nation how the election can be rigged in a tumultuous time such as in the current pandemic. Not that electoral fraud had not happened in past elections, but the scale of it is much, much bigger in this election, to the extent that frauds can be caught even by human eyes. If we, the intercessors, are convinced that frauds did exist in this election, how can members in the government not? At present, almost all claims of frauds were not being heard by the Supreme Court, even they come with good evidences. The Democrats turn a blind eye to them. Some Republicans admit there are frauds but they are afraid to rock the boat if they dig hard into them. The big media, big tech, Wall Street said claims of frauds are baseless. If the Constitution is the guide for our government, should we expect the government to do as what the Constitution says without any avoidance or hesitation to safeguard our electoral system? America is not a banana republic. If the electoral frauds committed in this election are not fully investigated and rectified, we can’t even trust our own government, how can this nation be a leader in the free world?
Father God,
You said in Ezekiel 33:7-9 “So you, son of man, I have made a watchman for the house of Israel. Whenever you hear a word from my mouth, you shall give them warning from me. If I say to the wicked, O wicked one, you shall surely die, and you do not speak to warn the wicked to turn from his way, that wicked person shall die in his iniquity, but his blood I will require at your hand. But if you warn the wicked to turn from his way, and he does not turn from his way, that person shall die in his iniquity, but you will have delivered your soul.”
Father God,
Will you raise up your prophets within the government so your will can be made known to them? No more excuse for the Supreme Court to dismiss or delay fraud litigations, no more excuse for Congress to ignore claims of fraud. Until they know the word comes from you, they will continue to deny any claim of fraud and will not debate the validity of the electoral college result passed by the state electors on Dec 14.

Will you lift up Vice President Pence? He is in trouble now. He needs strength, courage and guidance from you to do the right thing on January 6 when Congress meets to confirm the electoral college result. Give him the leap of faith so he can do what the Constitution asks him to do without fearing pressures from the enemies. Give him the wisdom so he will prepare himself for a victory to overturn the fraudulent election results from the six key states.

What if VP Pence’s move to petition the court to remove his authority is a ploy? God knows what is needed and I pray God works in this and in all the voter fraud as well as all the corruption and chaos for His good and glory.

We implore you to show mercy to America, show mercy to all nations in the world. This world needs justice more than ever since the pandemic broke out in 2020. Since the fall of Adam, Satan has never stopped its evil works to humankind. The shocking electoral fraud which happened in America in the 2020 election might as well be another scheme of Satan to take down America, the city on the hill, to darken the light of freedom and truth in the western world. But Father God, Satan has no place to stop your great plan of salvation to humankind. Fill V.P.Pence with the Holy Spirit, Lord, so he may know what to say and how to say it boldly. Help Your people, Lord, to build our faith that “all things work together for good,” but also, “help our unbelief” in Jesus’s precious name.

We ask, Mighty God our Father, that the Constitution would be upheld, that the 1825 Act regarding disputed elections be enacted by both Chambers and by the decisive act of our VP. We remind ourselves that you led our Founding Fathers to frame a document that kept the people free from a wicked government, and so we say the dissenting voices of these unjust courts mean nothing. We the people stand on the Constitution as we do the Bible. Make all ways straight before VP Pence and those brave Senators and Congressmen and Women who are planing on objecting to the Electors. Almighty God, as we come together, realizing the many differences of America’s citizens, help us stand united as one nation under Almighty God’s authority. Father, we desire freedom and liberty for all, not only our nation but all nations of the world. We believe “wherever the Spirit of the Lord is, there is freedom.” (2 Cor.3:17) Dear Father, forgive us of our sins of commission, omission, and secret sins. Lord, forgive our complacency, political correctness, and tolerance of sin. Give us zeal, knowledge, and strategies to move forward for what lies ahead and for that which You have commissioned us to do. God, our focus is on You as we “press on to reach the end of the race and receive the heavenly prize for which God, through Christ Jesus, is calling us.” (Php.3:14)
We stand firm in faith believing that You, O God, will move America forward, in accordance with Your plan. If Your people who are called by Your name will seek first Your righteousness, pray, asking forgiveness for the sins of this nation, then will You heal our land. (2 Chr.7:14)
Jesus said, “I tell you the truth, anyone who believes in Me will do the same works I have done, and even greater works, because I am going to be with the Father. You can ask for anything in My name, and I will do it, so that the Son can bring glory to the Father. Yes, ask Me anything in My name, and I will do it!” (John 14:12-14)
The day of “greater things and greater works” is upon us, Lord. We pray for Your divine intervention, spiritual awakening, and revival in our nation.
Shake the rafters of this nation; let the rats and termites plummet and descend from their hiding places. Let them succumb to their own wretched decay of greed, and self-serving pretentiousness. Exterminate the governmental vermin feeding off our nation’s resources and residing in the kingdom of darkness. Remove the Godless workers of iniquity living privileged lives in total opposition to Your Word and Your Will. “And a final word to you arrogant rich: Take some lessons in lament. You’ll need buckets for the tears when the crash comes upon you. Your money is corrupt and your fine clothes stink. Your greedy luxuries are a cancer in your gut, destroying your life from within. You thought you were piling up wealth. What you’ve piled up is judgment.” (James 5:1-3 MSG)
Strengthen the honorable men and women who fight for this nation and uphold justice. Deliver them from the evil one. (Matt.6:13)
Lord God, we pray according to Your Will for our nation so that our prayers will be fruitful and greatly multiply. We maintain our spiritual position of authority; we pray against the spiritual war taking place in America that desires to seize the heart of our nation. “We cry out; hear our cry, O God, listen to our prayers; from the end of the earth we call to You when our hearts are faint. Lead us to the Rock that is higher than we are, for You have been our Refuge, a strong tower against the enemy,” (Ps.61:1-3). We cry out for this nation. Hear our cries for America! Jesus, as You sit at the right hand of the throne of God, intercede on behalf of this nation and her people. Holy Spirit, give us the intercession of Jesus for our nation that we might release the sounds of united prayer on earth, even as it is in Heaven. In Jesus mighty name we pray, Amen.
