Is Judge Chutkan infringing Trump’s First Amendment rights, or is she simply protecting people from harassment? What do you think?
From The Epoch Times. Judge Tanya Chutkan, presiding over the case against former President Donald Trump for allegedly interfering in the 2020 elections, ordered certain restrictions on what President Trump can say in relation to his case after hearing arguments Monday morning.

Judge Chutkan said she would not impose restrictions on statements he makes about Washington, D.C., or criticism of the government, including the Biden administration and the Department of Justice (DOJ). However, President Trump will be prohibited from posting statements attacking special counsel Jack Smith, his staff, Judge Chutkan’s staff and other court personnel, and the families of any of these individuals.
He is also limited in part about what he can say about potential witnesses; for example, he may make posts about former Vice President Mike Pence, but not in regards to underlying events connected to his case.
The judge said she would consider sanctions if President Trump violated the order. …
After the decision, a spokesperson for President Trump issued a statement: “Today’s decision is an absolute abomination and another partisan knife stuck in the heart of our Democracy by Crooked Joe Biden, who was granted the right to muzzle his political opponent, the leading candidate for the Presidency in 2024, and the most popular political leader in America, President Donald J. Trump. President Trump will continue to fight for our Constitution, the American people’s right to support him, and to keep our country free of the chains of weaponized and targeted law enforcement.”
Mr. Smith was appointed special counsel last November to investigate matters related to the Jan. 6, 2021, Capitol breach events, and this summer he unsealed an indictment against President Trump on four counts.
The prosecutors are arguing that President Trump is unfairly influencing the jury pool and had proposed a gag order that would limit what he can comment on related to the case, and limits on what kind of polling he can do in Washington, D.C. President Trump’s attorneys argued that the proposed order is not at all “narrowly tailored” and violates his First Amendment rights. …

Prosecutors claimed their order would not prevent President Trump from campaigning or defending himself, but defense attorneys argued their language for the proposed gag order was overly broad and did just that.
The prosecutors cited Gentile v. State Bar of Nevada, in which the U.S. Supreme Court ruled that limiting defense counsel’s speech did not run afoul of the First Amendment. …
Prosecutor Molly Gaston said the government had no interest in stopping President Trump’s campaign, but the sole objective of the motion was to ensure “fair” proceedings. She argued that derogatory, inflammatory, and intimidating statements attacking witnesses could influence not only the witness, but the public, and by extension potential jurors. …
Trump attorney John Lauro said his client is in the middle of a campaign. He argued that the DOJ is trying to limit President Trump’s speech, which has the highest level of constitutional protection. The judge reminded him that as a criminal defendant, President Trump agreed to comply with conditions of release which means he doesn’t have the right to do and say exactly as he pleases.
Mr. Lauro agreed his client is complying with the conditions of release, but pointed out that President Trump, a political candidate, should be able to speak freely on the issue of the day, which include the role of the DOJ and the appointment of judges.
Every single issue related to this case also has political implications, he said, adding that the prosecutors chose to bring the case in the middle of the campaign and have it “inextricably intertwined” with the campaign, which the judge scheduled for trial one day before Super Tuesday, when over a dozen states hold their Republican primaries. …
Other Gag Order
The defense seemed to be on shaky ground once specific posts President Trump made were brought up.
The former president is also currently on trial in New York in a civil fraud case, where he had made a social media post targeting the judge’s clerk. The post was later deleted after the court ordered it, imposing a narrow gag order that prevented any of the parties from attacking the judge’s staff.
Judge Chutkan said that post had been highly concerning, and suggested he was putting court staff in danger.
Mr. Lauro was asked whether that post should be acceptable, to which he responded that he would advise his client not to do something like that.
Judge Chutkan said that was not what she asked, and Ms. Gaston said a clear order was needed, not just Mr. Lauro’s advice. …

My prayer for President Trump is that he open himself to the proddings of the Holy Spirit: for salvation, for guidance, for strength. May the angels protect Mr. Trump as he navigates dangerous circumstances.
The gag order is temporary. It is meant to help ensure another right: our right to a fair trial and the right to live without fear on the part of witnesses. Those of us who oppose abortion understand that sometimes one right, freedom of choice, is limited when it crosses another right, right to live. Donald Trump’s remarks could prejudice a juror against him, so it is as much for his protection as it is for the case against him. His inability to control his speech is deeply troubling, especially for someone who sees himself as a world leader, who should set the standard for others.
Elizabeth, Judge Arthur Engoron is HEATHEN! Judge Tonya Chutkan is HEATHEN! Prosecutor Alvin Bragg is HEATHEN! Prosecutor Jack Smith is HEATHEN. Prosecutor Letitia James is HEATHEN! Prosecutor Fani Willis is HEATHEN! These renegades need to be disbarred and never allowed to practice in a court of law again! Why are you ignoring “abuse of process” and failure to recuse from a case? The First Amendment is absolute, even for Mr. Trump. You cross a line with Freedom of Speech when you threaten a witness and say they deserve to be executed, especially when you are a political leader who people follow in an unquestioning manner.

It is a set up, now if President Trump says anything the dirty democrats don’t like, they can ask that he be held in contempt of court and jailed without bond.

Remove unconstitutional gag order from Trump. This is an infringement on his constitutional rights This trial is a sham of over zealous liberals to interfere in Trumps ability and constitutional rights to run for office of president of the US.
I think it is a set up to have him violate the gag order to then have him held in contempt then arrested jailed without bond.
It is manipulation. The DC judges must be impeached by US congress! How dare the DC judges be so cruel and stupid.
Heavenly Fathery, I pray for Donald Trump. The charges should never have been filed. The foundation of the case is that Trump really didn’t believe the election had been rigged, But Trump’s lawyers were never allowed to present there case in any court in the land. Indeed, that was the plan for January 6, to have Senator Cruz and others bring forth the evidence so people, for the first time, could hear the case. The riot on that day prevented that from happening. Trump’s plan is to present, what is an overwhelming case, that there is in fact significant evidence supporting his views, demonstrating that he really believed there was election interference. This judge has a track record of biased statements regarding Trump and the January 6 defendants. D.C. has a track record of voting 96% democrat. It is impossible for Trump to with the case. Not letting him address these injustices is now compounded with another injustice. I pray that Trump and the January 6 defendants will receive justice.
Lord, in my opinion this trial is a sham and merely another political maneuver, however you are totally in control so we ask that you please extend your hand of grace and mercy over this former president during these very troubling times for all.

Judge Tanya Chutkan is heathen. Judge Arthur Engoron is heathen. Prosecutor Jack Smith is heathen. Prosecutor Alvin Bragg is heathen. Prosecutor Letitia James is heathen. Prosecutor Fani Willis is heathen. God knows what to do with these agents of Satan and needs to act promptly!
China stule justice
If a Billionaire needs to ask for political donations in order to afford his personal legal bills and the bills of other defendants that might have testimony detrimental to his freedom, he should seek them out. The First Amendment is not a blanket for allowing all speech. You cannot yell “Fire” in a crowded theatre where no fire exists. If he taints the process and makes it difficult to get a fair trial, can he then complain and appeal the lack of justice brought about by his own actions?
Barry, the supposedly neutral judiciary has been politicized. The current administration is perhaps the most egregious for promoting violation of judicial neutrality. Judge Tonya Chutkan is biased, refused to recuse herself, and needs to face a judicial ethics committee and a legal ethics committee, looking toward removal from the bench for obvious bias and promoting legal abuse of process. Same for judge Arthur Engoron. The prosecutors Alvin Bragg, Letitia James, Fani Wilson, and others should face legal ethics committees and disbarred for abuse of process. Taxpayers should not pay salaries for renegade government officials anywhere!

Since when does our right of Free Speech have an asterisk for anyone, let alone for a former president? Clearly the judge and the prosecutors in this case should have recused themselves because of their bias, but they haven’t done so.
Absolutely! Unfortunately, the devil is never going to stop deceiving the masses to follow him and leave God and His kingdom in a bind.
