The Troubling Story of John Eastman and Election Lawfare
On March 29, 2024, Benjamin Eastman and Christina Wheatland published an Open Letter in Blaze Media to draw attention to the attacks on their father, Dr. John Eastman. Those attacks bring to light how far leftist activists will go to destroy their opponents and deserve a strong prayer response on the part of God’s people.
Who is praying on the wall?
John Eastman gave legal counsel to President Trump while he was still in office on cases dealing with election fraud. He became nationally known after he spoke at the protest rally on the Ellipse prior to the events at the Capitol on January 6, 2021 riots. He authored the “Eastman Memos,” brainstorming papers in which he analyzed potential means of responding to the illegalities in the 2020 election that he had uncovered through investigation.
Since Jan. 6, 2021, Eastman has endured three years of malicious lawsuits, bar complaints, subpoenas, and testimony before the House January 6 committee. The lawsuits include his inclusion in the indictment of President Trump and 17 of his associates by Fulton County, GA, District Attorney Fani Willis on racketeering charges. In June of 2022, FBI armed agents frisked him and seized his phone, which they have kept in evidence for over two years. It prompted Tucker Carlson to host him on Fox News to share details of the encounter.
A new legal attack took place during Holy Week of this year. On Spy Wednesday, which commemorates the betrayal of Jesus by Judas Iscariot, California Bar Court Judge Yvette Roland issued a ruling recommending Eastman’s disbarment. It should be noted that this judge is a regular donor to the Democratic Party which may impact her ability to be impartial.
The attacks on Eastman are not limited to the legal arena. Activists have targeted him viciously, spiking his driveway, doxing his address by spraying graffiti around his neighborhood, sending him death threats, and protesting outside his residence for over a year. Their actions are consistent with the mission and goals of the 65 Project. This left-wing activist group attacks opponents of leftist lawfare by making them toxic in the community while claiming to defend election fairness.
And if that wasn’t enough, he was stripped of board memberships after decades of service. The same happened to his membership in academic conferences, with people claiming he was a threat. They canceled his university classes and forced him to retire. The Bank of America and USAA de-banked him. They humiliated him by forcing him to surrender himself to a prison facility, taking his mug shot, and saddling him with a bond amount typically reserved for violent criminals. They burdened him with millions in legal fees despite the fact that he was motivated to act to protect U.S,. laws and Constitution.
He and his family have drawn strength from Jesus’ words in the Beatitudes:
Blessed are you when they revile and persecute you, and say all kinds of evil against you falsely for My sake. Rejoice and be exceedingly glad, for great is your reward in heaven, for so they persecuted the prophets who were before you (Matthew 5:11-12).
It comes as no surprise that legal experts like Dr. Eastman have come under attack. The Republican Party has filed more than 73 lawsuits nationwide alleging election fraud and challenging shady and fraudulent procedures during the 2020 elections. Most of the left-leaning media have demeaned and dismissed those lawsuits as attempts to bend the legal system to the right. One of those was the New York Times, which published an article two years ago in which investigative reporter David Enrich tried to put the law firm Jones Day in a bad light. And the Left has stepped up efforts to undermine the fairness of the legal system with what has come to be known as “Lawfare,” which the Online Cambridge Dictionary defines as “the use of legal action to cause problems for an opponent.” Lawfare is the term that describes the all-out efforts against President Donald Trump: criminal and legal charges designed to impugn his credibility and keep him from being re-elected.
The vicious attacks on Dr. Eastman, the skewed portrayal of fair lawsuits by left wing media, and the growing intensity of lawfare should concern us. They conspire to erode the fairness and impartiality of our legal system as envisaged by our founding fathers when they established a system of checks and balances in our three-branch government. Individual federal and state laws represent the way constitutional law is handled. The more the rule of law is being misused for political purposes, the weaker our Constitution becomes as an absolute and impartial measure against which individual cases should be adjudicated.
Part of the impartiality of our Constitution comes from biblical law embedded in it. I believe that is why the legal system in America is under heavy attack in so many different ways. The devil hates anything related to the Kingdom of God, including Christian principles in the founding documents of a nation. Lawlessness will abound where the law loses its absoluteness, which is his ultimate goal.
How To Pray
Intercessors know that the battles we see are not against flesh and blood – we fight against “principalities, against powers, against the rulers of the darkness of this age, against spiritual hosts of wickedness in the heavenly places” (Ephesians 6:12). This is spiritual warfare about the Christian roots of our nation and the openness to the gospel. The left wants to move us toward post-Christian globalism and erase godly principles and values from our lives. The right wants to defend them. Each represents a side in this spiritual battle.
When looking at the attacks on John Eastman and the other examples of lawfare, the picture of Moses at the battle against Amalek comes to mind:
And so it was, when Moses held up his hand, that Israel prevailed; and when he let down his hand, Amalek prevailed. But Moses’ hands became heavy; so they took a stone and put it under him, and he sat on it. And Aaron and Hur supported his hands, one on one side, and the other on the other side; and his hands were steady until the going down of the sun. So Joshua defeated Amalek and his people with the edge of the sword. Then the Lord said to Moses, “Write this for a memorial in the book and recount it in the hearing of Joshua, that I will utterly blot out the remembrance of Amalek from under heaven.” And Moses built an altar and called its name, The-Lord-Is-My-Banner; for he said, “Because the Lord has sworn: the Lord will have war with Amalek from generation to generation” (Exodus 17:11-16).
Amelek represented Satan in the spiritual battle against the kingdom of God, as implied by verse 16. This picture gives us our prayer strategy, namely that we must hold up with the hands of those who fight on the side of God’s love for fairness and justice. Our intercession is their strength.
With that in mind, let us pray that God will protect and empower men and women like Dr. Eastman and frustrate the schemes of the Evil One so clearly present in the vicious attacks on them.
Father in heaven, we thank You for people who don’t give up the fight for fairness, truth, and justice like John Eastman. We pray for him today and the many others who have dedicated their lives to defend Your principles and values embedded in our nation. Strengthen and protect them. Expose the wickedness of their opponents. Multiply the number of capable fighters who can keep our legal system from becoming an evil political weapon. In Jesus’ Name. Amen.
