Only 1 day after signing the executive order, President Trump’s plans to end birthright citizenship are being challenged by blue states in courts across the nation.

After his inauguration on Monday, Trump, a Republican, ordered U.S. agencies to refuse to recognize the citizenship of children born in the U.S. if neither their mother or father is a U.S. citizen or legal permanent resident. …

The lawsuits take aim at a central piece of Trump’s sweeping immigration crackdown. If allowed to stand, Trump’s order would for the first time deny more than 150,000 children born annually in the United States the right to citizenship, said the office of Massachusetts Attorney General Andrea Joy Campbell. …

1898 U.S. SUPREME COURT PRECEDENT

Three of the four lawsuits were filed in Massachusetts and New Hampshire. Any rulings from judges in those New England states would be reviewed by the Boston-based 1st U.S. Circuit Court of Appeals, the only federal appeals court whose active judges are all Democratic appointees.

Four states filed a separate case in Washington state, which the San Francisco-based 9th U.S. Circuit Court of Appeals has jurisdiction over. U.S. District Judge John Coughenour in Seattle has scheduled a Thursday hearing on whether he should issue a temporary restraining order blocking enforcement of Trump’s order. …

The various lawsuits argue that Trump’s executive order violated the right enshrined in the Citizenship Clause of the U.S. Constitution’s 14th Amendment that provides that anyone born in the United States is considered a citizen.

The complaints cite the U.S. Supreme Court’s 1898 ruling in United States v. Wong Kim Ark, a decision holding that children born in the United States to non-citizen parents are entitled to U.S. citizenship. …

I will turn 73 years old in April 2025. If this Birthright law was passed in my Grandparent’s life, then I, my siblings and cousins would all have been blocked from becoming US citizens. When I consider the many ways we’ve proudly served our country – some in the military, some as teachers, some as trained volunteers in their local communities, some contributing to successful businesses and countless other ways. I pray that this bill will not be passed! There are many other ways to keep America strong. First of all – we need to return to serving the God of Abraham and teaching our children and others to do so. Thank you for allowing my voice to be ‘heard’.

We have out grown the born in USA equals citizenship. Other countries do have this citizenship rule. The ILLEGAL infilux with open border makes no sense to add another misused rule. Lawful entry and proper document immigrants are a different statu.

I agree with Pres. Trump. It does not make sense for a child to be a citizen when the parents cannot live here if the parent is not a legal citizen. Allowing citizenship to a child is inviting illegals to sneak into our country. The illegals have not been vetted which is for the protection of the current citizens. Illegals create a further tax burden because of their demands for health care, education, welfare that they have not contributed to; but they will probably need more in order to survive here (illegally). The parents need to go through the legal route for entry before the child can be a citizen.

After living in other countries, I believe this is the right thing to do. People fly to the US when it is dangerous for a woman to fly. They deliberately exploit the US by using “free” hospital services to have the baby and then using that child’s citizenship to get the whole family into the US. None of this is legal anywhere else in the world. It should not be so here. If neither parent is a US citizen, the child should not be a US citizen.

If a person that is a legal resident, meaning someone who came legally and subsequently has a child, that child is legally a US citizen. Anyone else is the child of a criminal because they broke the law in overstaying their Visa, entering illegally or some other reason which kept them here long enough to have a child. If neither parent is legally a US Resident the child should not be granted automatic citizenship for any reason.

i believe this is the correct thing to do. One revision I would suggest is that in the future if the parents gain US citizenship that citizenship would pass along immediately to the child. This would cover people legally working in the USA who eventually get their citizenship.

What is with the sudden amnesia in the liberal academia who made up birthright citizenship in the 1960s? There is no law or court decision that has even claimed such a thing as much as present day talking heads like everyone to believe.

Even in Obama’s birth year, the US Congress had a naturalization law (that pundits had liked to describe as “arcane” despite the 14th Amendment being much older than the statute) that gave a summary rule where if a child was born of only one US citizen that the parent had to reside in the US with the child at least 5 years. This is what can be called summary naturalization because a child attains citizenship by mere residency matriculation without having to go through the allegiance oath like adults aliens do. Where the child is born is irrelevant as the gamut of American jurisprudence rests on the Grievances and Resolves letters that the American Colonists sent to Parliament claiming that they have all the rights and privileges of an Englishman though they were not all born in England. The 14th Amendment changed none of this. The naturalization law of the time was also consulted that children born to embassy and consuls of foreign countries are excluded from the born in the US clause.

Obama’s mom did not stay in the US long enough and remarried overseas so he was neither summary naturalized nor a natural born citizen as a mixed nationality child: Kenyan American. When children are born of foreign subjects on US soil they are still foreign subjects and subject to the political jurisdiction of that foreign state, all without a passport from their home country if not here legally. For the child the foreign country likely does not know the child exists, and the parents where it may not even be known they are “missing”. When folks travel with a passport, and so authorized travel as non-citizens do not have the right to interstate travel, they are documented from their country of origin. Yet, they are still citizens of that foreign country and so subject to that jurisdiction. In either case, documented or undocumented does not in any case confer citizenship for just being born on US soil. Back when the 14th Amendment was ratified under unconstitutional means, people could only travel by steamship at best. When immigrants came that route they were registered most often on ship manifests recording their native town, what port they left, what port in the US arriving, and final destination as an audit trail where alien persons come from and are going all the while subjected to admittance review and usually had to have an address of a sponsor. If they did not have these arrangements, then they were subject to being sent back. Otherwise they were deemed defacto immigrant aliens who may be eligible for citizenship if they reside long enough and apply through the appropriate channels declaring their allegiance to the US disavowing their native country sovereigns. The right of interstate travel is a political right of citizens of a country. As aliens are not citizens they are subject to the collective rights of the sovereign state against trespassing. When aliens are in a foreign country, they are not free persons in that country. They are not free.

I think that the motivation behind this is an effort to convince immigrants to begin the process to go through the channels toward citizenship. Illegal immigrants, once they go through the process, no longer have to live under the threat of the possibility of getting deported. Those who would try to take advantage of the knowledge of a families “illegal” status here, would lose all power over them. These new “citizens ” within our country could press-on with their dreams of a better life, with no “fears” holding them back. If this move prompts perspective Americans to go about being here the right way, then it is going to be a good thing for ALL who want to be in the U.S.A.

We should not keep allowing non citizen’s children to automatically become citizens of America. If they want to become citizens, they can do it legally. In most other countries, including Mexico, babies do not automatically become citizens by being born there.

I was raised in the Air Force, my father was 24 year active duty non-comm officer.
My youngest brother was born in 1964 in Okinawa while we were stationed there. My parents had to take my brother back to the United States before he turned 1 years old to file the proper paperwork so he would have United States citizenship.
I don’t know if this has since changed for the offspring of enlisted personnel born abroad.
Back then citizenship was not an automatic birth right, even to the children of military personnel, so it shouldn’t be an automatic birth right for the children of persons who are in the United States illegally.

    I totally agree with what the POTUS Donald Trump has placed into order. No other nation in the world has a law in place that allows automatic citizenship for people born in their countries that are not citizens of their countries to received automatic citizenship for being born in their countries. To challenge this is absurd. We as USA Citizens shall not allow it. This is why our public benefits are being depleted. Send these non citizens babies back with their illegal parents to their own countries to used their own countries public benefits. Stop stealing what belongs to our USA Citizens who have legal rights to our USA benefits.

Well, only people who come into this nation through the immigration channels set up should be allowed to stay here. Those children who were born here, can always return with their families once the adults go through the correct channels.
Much of this is a question of using common sense and logical conclusions. A child is not able to support himself, so the question of a child staying in the US because he is born here is an easy logical answer, they simply cannot. People can go off the rails with this stuff and make every issue a major point of contention if they choose to, while the logical answers are quite simple and plainly obvious.

      The point is: are the parents legal or illegal? That’s what decides everything. And anything illegal is a CRIME.
      We have had strict rules, but President Biden purposely disregarded our laws and invited illegals over the border without conducting checks. So Trump is simply correcting his predecessor’s outrageous actions!

On the subject of Birthright I have met one or two adults born in a specific Country and when grown up were citizens of 2 Countries and could live in either but that gave no entitlement to the Parents of that child born in say The US! Hope this helps!

I think in connection of the border crisis, it is the right thing to do. I’ve heard and believe some people are coming to our country illegally just for that purpose.

I have an acquaintance who has come to CA every time she’s 6 mos pregnant to rent until delivering her child to get an American birth certificate. She is married, lives in Europe, is not on any American gratuities, jut wants her children (3 so far) to be citizens.

    Not so, read the 14th amendment clearly. It addressed citizenship rights, equal protection in response to issues related to formerly enslaved Americans (brought here illegally) following the Civil War. The phrase “jurisdiction” is an important restriction that will be considered when taken by the Supreme Court. I have shared about an acquaintance who, residing in another country, on no American “handouts”, comes every pregnancy to CA to live for the last 3 mos of her pregnancies (3 so far) so the children will have American birth certificates.

My grandparents, when children, were not citizens until my great grandparents became naturalized citizens. They were grateful to have left Europe and live in America. They took classes to learn about our history and government. They passed the necessary test to become naturalized and were so proud to be citizens in our land of opportunity. They worked hard and would never have thought of taking one dime from the government.

    But in the days of Emma Lazarus, people came over here on boats, taking weeks to get here. They planned to stay here and become legal citizens. People did not just fly over here on airplanes to have their babies be anchor babies. It was a very different era.

    But I look at it that RED is the proper color of Republican states, as they are mostly pro-life, Christian, Constitutional (our country was founded as a Christian nation), Conservative.
    To me RED represents The Blood of Jesus, representing LIFE.
    On the other hand, the Democrat states love to murder babies in the womb AND after birth. They celebrate perversion. They attack and undermine the Constitution and the Rule of Law. etc
    To me, as a retired RN, the Blue of the Democrat states represent Cyanosis, (blue, due to insufficient oxygen), a condition warning of impending death if not dealt with.

President Trump should specify clear distinction between children born in the United States of non-U.S. Citizen parents who are in the U.S. LEGALLY versus children born here of parents who are in the U.S. ILLEGALLY. Children born to foreign diplomats serving in the US are not US citizens at birth. Native American children born in the US after the 14th Amendment was in place were not US citizens at birth. The Indian Citizenship Act of 1924 granted citizenship at birth to Native Americans. It is obvious the words “and subject to the jurisdiction thereof” have an ignored and overlooked meaning.

As a social worker and now a nurse, I have witnessed hundreds of cases where women who are not citizens and who are from criminal backgrounds or who do not know a thing about what makes this country great come here at 8 months pregnant and get to stay because the child is their ticket. We have to examine the ones who’ve already been born because of the nefarious plans to undermine America by many other groups outside the US. added to this is the problem that it is not sustainable as has been brought up by others. The parents must be legal citizens period. Everyone knew that Biden was a puppet and a fake and himself an illegal president therefore it really needs to be rolled back. They flocked in here seeing a loophole. They knew exactly what they were doing. And most of them never intended to learn the language here. We really really must get back a rule of law and order here. The other issue is when someone would discover that their child was going to be special needs, they would come and have that child here in order to get medical services which are extremely expensive to the American taxpayer. Medical services have routinely been provided to undocumented people as well. We’ve really got to examine these and at the very least ensure that they return to their country once they have received help.

I would agree they should not be a citizen just because they are born here.How many mothers were pregnant before they came in illegal just to have the child to become a citizen.if the parents came in illegal them and the children should have to leave and go back where they came from then try to come back the legal way,like the ones here that came the legal way.Talking to people that I know that did it the legal way makes them mad cause they don’t think this right.

I understand the 14th Amendment. What I don’t understand is why are these parent’s not wanting to become American citizens?? My mother was from Belgium. My father met her during WWII while he was stationed there and married her. They came back to American and she immediately took the classes and the test to become an American citizen. She also worked very hard to learn our language. Can someone explain why they do not want to become American citizens, but they DO want to live in America???

The 14th amendment intention was to ensure Post Civil War slaves and children conceived thereafter were deemed citizens and later expanded to include all members of every Indian tribe in Ameria and all children born thereafter. Also later clarified by the Supreme Court that did not include children born here to citizens of foreign countries while serving as diplomats and those attending colleges/universities on student visas. It was never ever intended to grant citizenship to children born to those who were in USA ILLEGALLY! Whether it can be addressed by the SCOTUS or requires the process to amend the 14th this is how the POTUS id beginning the process to “FIX”.

When we lived in Singapore and Malaysia, we were not allowed to claim citizenship in those countries for our children who were born there. We got a Consular report of birth that established them as American citizens because we were American citizens. Seems reasonable

The pregnant mother better come in the US country with legal intentions then. She should not be traveling as an illegal having intentions of giving birth to her baby in the US with free healthcare for her and her child, her intending for her baby to be a US citizen. This can be a problem I see.

It’s unsustainable to continue to foster these children for perpetuity. The US needs to provide for its citizens first, the ones who pay taxes and work hard to maintain a livelihood for their families. I think that the president will not revoke the existing anchor babies but will cease to continue to foster anchor babies. No other country has this mandate in place for obvious reasons. We have to rule wuth reason for the good of the country and its citizens first. Most everyone agrees that immigrants are welcome when they follow the process of immigration legally. Trying to come into this country by using a baby to achieve this is not morally good.

I belief if we look in the scriptures on how Kings were expected to run there land, we will understand Trumps decisions. A position of an Annioted King will never be run or move by emotion but is annioted to accomplish God’s will which in many case God desired to wipe out a certain seed. Every plant is produce after its kind so if the parent is connected to the roots of another nation who serves another god then we know the child will grow up with there parents strongholds and usually parents don’t realize there life is what allows good or bad in a child’s life. That is why when I parent is an addict the child becomes and addict. Unless one is born again they are none of his either way. God wants America consecrated unto himself. And the seed who refuses to bow to God will have to be pushed out and yes with there children. This is SPIRITUAL LAW and wisdom. It doesn’t mean God doesn’t desire for them to be saved. God is able if he wanted to bring these people in. But he doesn’t want to for a reason we don’t understand. Prophecy revealed that it is God using Trump to do his will. Let us not forget the seed of Cain. But the righteous root in America WILL NOT BE MOVED.

I agree with President Trump’s EOs. The fact that he’s challenging the 14th Amendment makes me think there’s more to this Amendment than we realize. Here again, the past proves present. May all nefarious plots against our Constitution be exposed. May justice reign in our land so we all can live in life, liberty, and the pursuit of happiness.

In his speech to the Senate, Senator Jacob Howard, of Michigan, openly stated that the 14th amendment birthright clause “do not apply to aliens”. This was the original intent. In the Ark case, his parents had been in the US 20+ years and had been working in the US. This is NOT an “anchor baby” case. Certain radical immigration groups have maligned, misused and abused the court’s findings.

No other country allows birthright citizenship. The Supreme Court needs to uphold this order and it needs to become national law. This is an outdated decree that needs to be reversed.

There are or maybe better stated, there have been many abuses of that law or rule. People coming over on purpose to birth their child on the US side of the border just to get onto the social services. Rush used to remark how that for many years people coming into this country were not assimilated into America. it used to be that some education about the country was expected and some basic questions needed to be answered. it also used to be that a person applied to come to the US and waited their turn in their own country until the quota opened up.

Your Kingdome come, Your will be done in all the decisions surrounding this matter. Blow your breath upon any and all of the courts, especially all the justices who have allegiance to the Democrat party instead of the biblical charge out of Deuteronomy. take heed what you do for you do NOT judge for man, but for the Lord.

America is the only nation that does this. I believe if you are legally here than it’s a good thing but illegals babies should not be able to have the birthrights of America. That is many times the reason an illegal sneaks in. That may stop some of the flow of illegals if they know there will be no birthrights. I think he should not go backwards tho to illegals that have been here before this ruling. Begin now. God has placed people all over the world to live in countries. All cannot live in America but if they desire must come in the legal way. Father give Presi. Lord, since many use birthright citizenship to circumvent the normal legal requirements to become a citizen in order to then milk the system and get free benefits, I believe it is time to revoke it. It is time to prioritize meeting the needs of current citizens, and bringing stability back to our nation. Immigration is not a right, it is a privilege. Please intervene in this situation to accomplish Your will and purposes. Enable those from struggling nations to find ways to make a difference at home instead of leaving and coming to the USA.

A child born in the United States, has the privilege of citizenship by birthright. This privilege is not extended to his or her family members if they are not citizens.. For the child’s family to remain in our country they must become naturalized citizens by the laws of our country. If, for some reason, members of the family cannot become naturalized citizens by our laws then they must leave the country. They have the option to take their child with them, or to leave their child and return to their country of origin.
If the child stays with his family and
returns to their country of origin, then the child’s citizenship should become in active. If the child should return to the US later in his or her life, then he or she can reactivate their citizenship per requirement set by our laws..
if the family leaves the child and returns to their country, then the child is a ward of the state and can be put up for adoption by other family members who are citizens or other citizens.

Lord Jesus, help our President to seal the borders of our country from this situation in which we are being strong armed into accepting mean, vile and evil entities. They come to the United States and knowingly and strategically have children so that when deportation is considered they can claim their child is a United States citizen. This must change because our country is being overrun with spirits that are running rampant. These spirits are misusing and murdering the resources of this country. The disparity is the fact that those who have children naturally born to fully vested United States citizens are being denied these resources. We thank you for the breakthrough.
