SCOTUS Allows NIH to Cancel DEI Grants
In a 5-4 ruling on Thursday, the Supreme Court allowed the Trump administration to move forward with cancelling National Institutes of Health (NIH) grants linked to diversity, equity, and inclusion (DEI) initiatives.

The decision partially lifts a Boston-based judge’s ruling that declared the cancellations illegal and blocked the administration from moving forward.
Five of the court’s six Republican-appointed justices sided with the administration: Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett.
They said the judge wasn’t following the high court’s emergency decision this spring allowing the administration to cancel education grants. Gorsuch was the most pointed in his criticism, accusing the judge and several others of defying the high court.
In February, the NIH moved ” to terminate grants that do not align with President Trump’s priorities,” according to The Hill. This included grants related to DEI programs. A district judge initially blocked the cuts in a decision that was upheld by the 1st U.S. Circuit Court of Appeals. Thanks to the Supreme Court, however, the NIH can move forward, at least for now.
The Hill notes that the high court’s ruling is not final, and the case could be returned to the Supreme Court at a later date. This is still, however, a win for the Trump administration.
