After two righteous 6-3 victories in the 2025 term – Mahmood v. Taylor upholding a parent’s right to opt their children out of LGBTQ+ literature in schools and U.S. v Skrmetti upholding a state’s right to ban transgender treatments on minors – the Supreme Court has agreed to review in its next term, beginning in October.

In two landmark cases, State of West Virginia vs. B.P.J. and Idaho’s Little v. Hecox, the Supreme Court will determine if transgender females (biological boys) can join girls’ sports teams at public schools. Both states passed laws specifically stating that school sports teams are based on “biological sex”. Appellate Courts in both cases had ruled against West Virginia’s and Idaho’s laws, stopping them from going into effect.

West Virginia v. B.P.J.

In 2021, Becky Pepper-Jackson (B.P.J.), a biological male identifying as female, challenged West Virginia’s law, the Save Women’s Sports Act. B.P.J. had been banned from joining the girls’ cross-country and track teams.

B.B.J. had been identifying as a girl for five years and had been on puberty blockers since the third grade. West Virginia had issued B.P.J. a revised birth certificate changing his sex from male to female. He is now 15 and has begun cross-sex hormone therapy. He has finished ahead of nearly 300 girls in three years of competing on his middle school girls’ team.

The U.S. Fourth Appellate Court ruled B.P.J.’s exclusion from competing on the girls’ team was a violation of Title IX, which forbids sex discrimination in education, including school sports. Title IX was enacted in 1972 to encourage and protect female sports programs in public schools that receive federal funding. President Biden expanded Title IX to cover gender identity, but the expansion was rejected on January 9, 2025, by a federal judge.

A week after the Supreme Court ruled in the Skrmetti case, West Virginia filed its case requesting the Court grant its petition as Skrmetti did not “address critical questions unique to athletics.” Within nine days of West Virginia’s filing, the Court agreed to hear West Virginia’s and Idaho’s cases.

Little v. Hecox

The Idaho case was brought by Lindsay Hecox, a Boise State University male student identifying as female. He, too, wanted to join the women’s track and cross-country teams but was denied because of Idaho’s Fairness in Women’s Sports Act.

The U.S. Ninth Appellate Court agreed with Hecox and stopped the state from enforcing the law.

In 2020, Idaho was the first state in the country to enact a ban on transgender athletes in female sports. Hecox also claimed the law violated Title IX.

What the Cases Will Decide

Both cases are being brought by West Virginia’s and Idaho’s Attorney Generals along with Alliance Defending Freedom (ADF) as co-counsel.

The question the Supreme Court Justices are being asked to decide is: Do laws seeking to protect girls’ sports by limiting participation on female sports teams based on biological sex violate the equal protection clause of the 14^th Amendment?

The Court will also decide whether Title IX prevents a state from designating girls’ and boys’ sports teams by biological sex at birth.

ADF’s CEO, President, and Chief Counsel Kristen Waggoner said, “Women and girls deserve to compete on a level playing field. But activists continue their quest to erase differences between men and women by forcing schools to allow men to compete in women’s sports. This contradicts biological reality and common sense. We should be seeking to protect women’s sports and equal opportunities, and West Virginia’s and Idaho’s women’s sports laws accomplish just that. We are pleased the court will listen to the countless girls across the country speaking out on this issue and restore fairness and safety for female athletes.”

These cases will likely be argued in the fall of 2025, and a decision isn’t expected until June of 2026.

Is the Trans Tide Turning?

Twenty-seven states have passed laws that restrict biological boys from playing in female sports.

President Trump issued an Executive Order entitled, Keeping Men Out of Women’s Sports, banning male athletes playing in girts sports in public schools.

The House of Representatives had passed a bill, the Protection of Women and Girls’ Sports Act, to ban transgender students from playing in women’s sports. The Senate, however, failed to get the 60 votes to end the Democrats’ filibuster, effectively refusing to vote on the bill.

However, the University of Pennsylvania recently stripped trans swimmer Lia (William) Thomas of his titles and restored them to the female swimmers who lost to him in swim meets. The university will also not allow males to compete in female athletic programs. Thomas had dominated the women’s meets after switching from the men’s swim team to the women’s. He recorded the nation’s fastest women’s swim times in the 200 and 500 freestyle events in 2021. He won three Ivy League championships and a national championship in 2022.

In fact, according to a U.N. study, trans athletes have “stolen” over 900 medals from female athletes. Remember, it was two biological males who competed for Gold in Women’s Boxing at the Paris 2024 Olympics.

But in 2022, the World Aquatics restricted trans swimmers from competing in women’s swimming events, announcing they must have completed their transition by the age of 12 and maintain low testosterone levels, effectively barring trans females from the sport.

In 2023, the World Athletics Council banned trans females who had gone through puberty from participating in women’s track and field events.

In 2025, the National Collegiate Athletic Association NCAA banned transgender women from women’s college sports.

The lawyer for the trans athletes, Joshua Block of the American Civil Liberties Union, states that banning transgender athletes will make schools “less safe.” But numerous girls have been physically hurt by these trans athletes, some seriously. Where are the safety concerns for these girls forced to play against physically stronger males? Many coaches are not allowing their girls to play against teams with trans athletes, forfeiting matches and often championships.

The Most Closely Watched Cases

These two cases will be among the most closely watched in the Supreme Court’s upcoming term. The Court took up these trans cases a mere two weeks after issuing its 6-3 decision in its Skrmetti and Mahmoud decisions.

Does that mean the Court is anxious to deal with the equal protection argument regarding so-called transgender rights in sports and decisively decide just who Title IX covers?

The tide does seem to be turning against the trans agenda. New scientific evidence is irrefutably proving the harm of trans treatments on minors. Nearly 70% of Americans oppose biological males competing in female sports, according to Gallup. Americans are growing increasingly tired of the pronoun bullying. In fact, nearly 60% of Americans oppose the use of “preferred” pronouns in school.

A Supreme Court ruling upholding state bans on transgender athletes will smack down a significant portion of the trans activists’ agenda and perhaps end the transgender madness in believing that one can defy God the Creator and change one’s sex.

Intercessors, we must pray. “I, the LORD, have called you for a righteous purpose, and I will take hold of your hand. I will keep you and appoint you to be a covenant for the people and a light to the nations.” (Isaiah 42:6)

God delivered amazing victories in the Supreme Court’s last term for religious freedom, parental rights, states’ rights, and more, regarding the trans agenda. We must continue praying to end the unfairness of biological males competing in female sports. We must pray for an end to the transgender madness and the LGBTQ+ agenda being forced upon us.

“For behold, the darkness shall cover the earth, And deep darkness the people; But the LORD will arise over you, And His glory will be seen upon you.” (Isaiah 60:2)

Let Us Pray

1. Pray for every Supreme Court Justice to rule according to God’s Will in West Virginia v. B.P.J. and Little v. Hecox, and acknowledge the truth of God’s creation of male and female.

2. Pray that the Supreme Court’s decision will recognize biology, restore sanity and fairness for female athletes, and end males competing in girls’ sports.

3. Pray that the Court will make their decision as a matter of policy for all sports in all schools and uphold the state bans on transgender athletes playing on female teams.

4. Pray that every state will pass laws banning biological males from playing on women’s sports teams in all schools and universities, both public and private. Praise God for the 27 states that have already done so.

5. Pray for the petitioners in this case, Lindsay Hecox and Becky Pepper-Jackson. Pray that the cross-sex hormones they are taking will not harm their bodies. Pray that the blindness and confusion they and their parents are experiencing will be lifted by God, and they will see His truth and be set free from the chains of transgender ideology. (John 8:32)

6. Pray for all those believing the transgender lies “to open their eyes, in order to turn them from darkness to light, and from the power of Satan to God, that they may receive forgiveness of sins and an inheritance among those who are sanctified by faith.” (Acts 26:18)

7. Pray for every child who is currently experiencing gender dysphoria and is confused about whether they are male or female. Pray that God will lift this confusion and suffering from their minds and bodies. Ask God to heal them, redeem them, and show them the abundant life waiting for them in the loving embrace of Jesus, within whom their true identity lies.
