Progressives Sue Tennessee Over New School Choice Law
A group of parents and progressive advocacy groups have filed a complaint against Tennessee over a recently passed universal school voucher law, claiming that it violates the state’s constitution.

Filed last week in the Chancery Court for Davidson County, Twentieth Judicial District, the lawsuit alleges that a new voucher law “is incompatible with its constitutional duty to provide an adequate education to all the state’s children through a single system of free public schools.”
In February, Republican Tennessee Gov. Bill Lee signed the Universal Voucher Law, which created an education program making nearly all school-age students eligible for a $7,295 voucher.
“I learned a long time ago that education changes the trajectory of a child’s life forever,” Lee said back in February, in comments cited by The Tennessean. “Today we put in place a piece of legislation that will change the future of Tennessee forever, because it changes the trajectory of the next generation of Tennessee.”
The suit claims that the new law violates the Education Clause of the Tennessee Constitution by having the state “fund private schools outside the public school system” and by further reducing public school funding below adequate levels.
“If the program is permitted to stand, it will continue to drain funds from under-resourced public schools and send hundreds of millions in taxpayer dollars to unregulated private schools,” reads the complaint.
The groups representing the plaintiffs include the American Civil Liberties Union of Tennessee, the Education Law Center, the Southern Education Foundation, the Southern Poverty Law Center, and Robbins Geller Rudman & Dowd LLP.
“Tennessee’s Constitution is clear: the state must maintain and support a system of free public schools,” said Lucas Cameron-Vaughn, senior staff attorney with the ACLU of Tennessee, in a statement provided to CP.
“This voucher scheme does the opposite,” he claimed. “It siphons desperately needed resources away from public schools that serve all students and hands that money to private schools with no accountability, no transparency, and no obligation to serve every child.”
The governor contends, however, that it will not draw support away from public schools, stating that the law “doesn’t change anything about the state’s obligation, as it currently stands, to educating children.”
Lee also said back in February that while there were “a lot of details to work out” on implementing the state law, “we already have an education savings account plan in place in this state for our three largest school districts, so we have some expertise within the department in how to implement this plan.”

As a home education advocate in TN this law is not good, as most home education families are vehemently against government money because it has usually led to government control. This is not free money, things from the government come with strings attached. We do not want the government to try and overregulate hpme education, make it hard or illegal, tell us what or how to teach our children or anything else. This would not be good for homeschooling families and federal and state organizations oppose this law. We have a God- given mandate to teach and disciple our children and we pay our own way. There are many ways to teach our own children low cost. It also promotes government dependence and is taking money from some to pay for others. It can also be used by people who make enough to pay for private schools to not pay it all but have it subsidized which isn’t good. Some Christian schools charge way too much money and school choice vouchers or money could be used to pay for those schools and more children be sent to them which could cause them to continue to charge way too much.
We need Dads and Moms teaching their children at home as God intended and was done for most of the history of the world. Please be advised on this and pray this is overturned and do not support this law.
Lord please turn the hearts of parents to teach their children how to be saved and follow You at the earliest age possible! And to teach their children at home as You want us to. Rescue children from babylon and get them out of public schools that can teach ungodly things, be dangerous, and do not work. Please let people see school choice around the country as not good and show peopl that just because it sounds good it doesn’t mean it is. You are the best ever God You are perfect! I am a retired teacher (retired in 2021) in Ohio and I commend Governor Lee for sending funds with the children. The Federal Department of Education started by Jimmy (inadequate president)
Carter in 1979 as a favor to a political acquaintance has been horrible. The level of credible teaching has gone down in our public schools where they play cnn news, rather propaganda in the mornings. In social studies
books for 6th, 7th, 8th grades where I last taught, Hinduism, Islam, and other false religions were taught to the point of indoctrination where Christianity is briefly mentioned with talk of the Crusades and very little mention if JESUS CHRIST. Parents, please go into schools all over America to see exactly what and how your children are being
taught. If you disagree, please pull your children out of public schools immediately. FATHER GOD please let the lawsuit against Governor Lee completely fail. Let school districts across America be reminded that our children belong to their parents and YOU alone. Give parents wisdom on how to pull their children out of public schools and where to send them, or how to teach them at home, just as YOU did me in 2001 when YOU told me to pull my children out of public. Thank YOU for protecting our children and for continually exposing the evil in public education in the NAME of JESUS! Amen.
