God, we thank You for inspiring states to put the Ten Commandments in classrooms. We pray rulings like this one would not stop children from hearing Your Word and learning the impact Scripture has had on our nation.

A federal judge has issued a temporary injunction blocking a Texas law that would have mandated the display of the Ten Commandments in every public school classroom across the state.

In his ruling on Wednesday, U.S. District Judge Fred Biery in San Antonio temporarily prohibited 11 Texas school districts from displaying the Ten Commandments.

The Clinton appointee said a lawsuit filed by a coalition of Dallas-area families, faith leaders and civil liberties advocates raised questions about the constitutionality of Senate Bill 10, which would have required the displays in schools statewide starting September 1.

The decision marks the third time a federal court has struck down such a state-level requirement, following similar rulings in Louisiana and Kentucky.

Biery’s 55-page ruling emphasized the potential impact on students and teachers, noting that “even though the Ten Commandments would not be affirmatively taught, the captive audience of students likely would have questions, which teachers would feel compelled to answer. That is what they do.”

He maintained that such displays could lead to unintended religious discussions, placing educators in the difficult position of navigating complex theological issues in a public school setting, potentially infringing on students’ rights to a secular education.

As an example, the judge offered a fictional account of a similar law in Hamtramck, Michigan, where the majority Muslim community “decreed” that the Quran should be taught in public schools. As part of the example, Biery quoted directly from the Quran.

“While ‘We the people’ rule by a majority, the Bill of Rights protects the minority Christians in Hamtramck and those 33 percent of Texans who do not adhere to any of the Christian denominations,” the judge wrote.

He also cited the biblical accounts of Abraham leaving the land of Ur to proclaim, as the judge wrote in quotations, “the one true God.” Naming Moses, Jesus and Mohammed as the “triad of the ‘desert religions,'” the judge said elsewhere other belief systems were formed, including “those which have come to exist in the American experience.”

Claiming that humans “evolved over several million years to be the only species which knows it will die,” Biery attributed the rise of human religion to people “not wanting their existence to end.”

Quoting everything from Stephen Hawking to Sonny and Cher, the judge also quoted from John 11:35, saying Jesus — who he called the “cousin” of Moses and Mohammed — would have wept if he saw the “blood spilled by their followers against each other.”

Writing that SB 10 “officially favors Christian dominations over others” and “crosses the line from exposure to coercion,” Biery expressed concern that public displays of the Ten Commandments “are likely to send an exclusionary and spiritually burdensome message” that would identify the plaintiff families as “the other.”

“The displays are likely to pressure the child-Plaintiffs into religious observance, meditation on, veneration, and adoption of the State’s favored religious scripture, and into suppressing expression of their own religious or nonreligious backgrounds and beliefs while at school,” the judge wrote.

In his closing statement, Biery — a 77-year-old known for using puns and colorful language in his rulings — appeared to suggest Christians might resort to violence in response to his ruling. He offered a “prayer” using the New Testament phrase “grace and peace” and concluding with “Amen.”

“For those who disagree with the Court’s decision and who would do so with threats, vulgarities, and violence, Grace and Peace unto you,” he wrote. “May humankind of all faiths, beliefs and non-beliefs be reconciled one to another. Amen.”

The suit names 11 of some of the state’s biggest school districts, including Houston ISD, Austin ISD, and Plano ISD, but notably excludes Dallas ISD. The plaintiffs contend that the law passed by the Texas Legislature in 2024 violates the First Amendment’s Establishment Clause, which ensures the separation of church and state, and the Free Exercise Clause, which protects individuals’ rights to practice their religion freely.

The case is expected to move to the 5th U.S. Circuit Court of Appeals, which ruled against a similar Louisiana law in June, before potentially advancing to the Supreme Court, where a 6-3 conservative majority could redefine the boundaries of church-state separation.

Because the judicial system is problematic, this issue should be addressed. The system of appointments is questionable; so new guidelines for appointing judges are in order. Prayer for wisdom to help solve issue is in order. The constitution and bylaws that were created for America need to be applied. The judicial, executive and legislative were put in place to correct each branch.

Father, in heaven, as we all have read this judges’ diatribe, it’s clearly a ton of mixture of lies with a little bit of your truth. I believe your court is in session in heaven, and we bring this case before you. We ask that you bring just judgment to the words this individual has spoken against The Covenant we have through , Yeshua your Son and his blood on the cross, fully established. We declare and decree and agree with you Father, that your word through the 10 Commandments will stand in Texas and be posted in our classrooms, in the precious name of Yeshua!

Biery suggesting that christians might resort to violence because of his rulings sounds like words that satan put in his mouth. He can cherry pick the bible all he wants to make himself sound knowledgeable about God but he is missing the point. God gave us 10 commandments to live by to save our soul. Mankind that think they know better than God on how to live needs thousands of laws which creates an environment for satan’s evils to grow. So as others have stated the sexual material and homosexual behaviors are ok but the bible isn’t. I wish mr biery would read these replies to his insulting our intelligence then he needs to prostrate himself and ask for God’s mercy. I do mot wish violence on you only that you repent and seek God’s wisdom before rendering a judgement and then making stupid comments. I trust God to take care of this

The judges ruling is condescending to say the least. He has a mixed conception of the Gospel of Jesus Christ which he is attempting to persuade the unsuspecting. Be aware of the false unity movements that are based on deception. He is of the blind leading the blind that fall into a ditch. I do pray and ask the Lord to allow His precepts and proclamations be publicly displayed, even at our schools. Amen

When I attended school there was pray (Our Father) Pledge Allegiance to America and we knew about the Ten Commandments. When Madelyn O’Hare went to the Supreme they abolish prays out of our schools. I graduated in 1965 our morals, values and dress code were in place. I went back to visit my school and it was a mess. No dress code, increase drop outs with boys and girl, education down, pregnancies up, etc. Look at the results because pray, etc. was taken out of our schools. But we can permit a LGBT flag in our schools and Gay Queens, etc.

The Word of God states:
God created man on the 6th day. We did not evolve and we will not die if we confess our sins and ask Jesus Christ for Salvation. For God so loved the world that he gave his only and unique Son, so that everyone who trusts in him may have eternal life, instead of being utterly destroyed. CJB

The Word of God states:
And it is all from God, who through the Messiah has RECONCILED us to himself and has given us the work of that reconciliation, which is that God in the Messiah was RECONCILING mankind to himself, not counting their sins against them, and entrusting to us the message of RECONCILIATION. Dear Heavenly Father, I love You and rely on Your Word for my life…my eternal life. I disagree with Fred’s decision but not with threats, vulgarities or violence. I disagree as it is contrary to the Gospel. I am eternally thankful that I have been reconciled through the Your Son, Jesus the Christ. I appeal in His Righteousness that true reconciliation will come to Fred Biery and all others who believe lies. I pray they will be reconciled to You. If not LORD, remove them, all of them, from positions of leadership. Silence them but please LORD, let them know their adversity is due to Your judgement….true, just and ETERNAL. May this be so.

The USA is a Christian nation, we are a city on a hill proclaiming the faith of Jesus Christ.
Schools were created to teach people how to read the word of God. Now let’s make sure the word of God is in our schools which we the people have established. American laws are to be followed not someone else’s opinions.

    You are absolutely correct Elaine! Over 90% of our Founding Fathers were Christian and many signers of the Declaration of Independence wanted children to learn to read so they can read the Bible.
    They wanted Christianity and morals taught for a prosperous nation and also life.

This judge’s statements made me gag. It is mindless drivel! It has nothing to do with separation of church and state, because posting something does not establish a state religion. It is simply an attempt to exclude YHVH from the public forum and silence His voice – the only One who can bring hope. He will not be silenced, but those who attempt to do so will find their voices stilled.
Sorry to resort to sarcasm, but can you imagine how horrid it would be to have a populace that recognized YHVH as the One and Only True God who redeems, that they worshipped Him alone, as He desires to be worshipped and spurns idolatry and does not swear oaths in His name?! How horrid it would be if our children learned to honor father and mother, to not murder, to not commit adultery, to not steal, to not give false evidence, to not covet?!
Please forgive us, Lord, for we have greatly sinned against You in this nation.

America has had a long history of prayer and Bible reading in public schools before the 1960’s. I have learned that certain people were offended by these good practices, brought up lawsuits against these good practices, and won their cases, thus making these good practices illegal. I believe it is time to stand up for the truth of what is right, and not cowering to those who are offended by what is right. Posting the Ten Commandments in every public school classroom is the right thing to do in spite of some people being offended. I believe the Ten Commandments provides a healthy way of living, and it does not force a person to believe in God. Thus, posting the Ten Commandments does not violate the separation of church and state. I pray that this judge’s mistakened ruling in Texas will be overturned in Jesus’ Name!

Dear Father,
I would hope that posting the ten commandments in schools would be the first step in admitting to school children that the United States began as a nation that believed in the One True God and based many of its laws on the Bible. Yes, other religions have emerged in our nation, but no religion has influenced our founding as Christianity has. People of other religions have to admit that. They have religious freedom in this country because it was founded on Christian principles. They should celebrate that, instead of despising it. Father, give us wisdom as to how to bring truth to our schools. Children are exposed to every worldly philosophy in the classroom EXCEPT Your truth. Give teachers and lawmakers and judges wisdom as to how to correct this tragedy! In Jesus’ Name, Amen
