Father, we thank You for the Supreme Court's ruling in Fischer v. U.S. We ask for justice for those who have been wrongly charged with "obstruction of an official proceeding."

For years, the media has insisted that an attempted “insurrection” took place on Jan. 6. Now, the Supreme Court has put that myth to rest.

From The Hill, Jonathan Turley opinion. The Supreme Court’s decision … in Fischer v. U.S. struck down one of the most common charges against January 6 defendants. “Obstruction of an official proceeding” had been used in hundreds of cases, and those convictions are now invalid.

But the biggest impact of the decision may occur elsewhere.

For years, calling January 6 an “insurrection” has been a litmus test for press, pundits and politicians. …

It now seems like the insurrection increasingly looks more like a legal case of mass trespass and unlawful entry.

I have always believed that criminal charges were warranted for the riot of Jan. 6, 2021. But this week’s decision shows how the Justice Department has wrongly prosecuted hundreds of people for the obstruction crime. It was all of what Justice Department official Michael Sherwin proudly declared in a television interview, that “our office wanted to ensure that there was shock and awe…it worked because we saw through media posts that people were afraid to come back to D.C. because they’re, like, ‘If we go there, we’re gonna get charged.’ …We wanted to take out those individuals that essentially were thumbing their noses at the public for what they did.”

The Fischer opinion will bring an end to a minority of cases that were based entirely on the charge under 1512(c)(2). The section had been enacted after the Enron scandal in 2001 with the collapse of an energy company accused of corporate fraud. It was designed to allow criminal charges for the destruction of evidence in the form of documents and records.

The Justice Department chose to interpret that provision to broadly include any obstruction of any legal proceeding, and then used it in hundreds of Jan. 6 cases. At least a quarter of the prosecutions included this charge. …

For most cases, the decision may require resentencing. Others with pending charges will go to trial without an obstruction claim. …

The obstruction charges helped complete the insurrection narrative for many in the press and politics. I have long disagreed with that claim. As shown by polls, most citizens view January 6 as a protest that became a riot, not as an attempt to overthrow the government . . .

The insurrection myth was used previously in court as Democratic secretaries of state sought to bar Trump from ballots under a meritless constitutional claim that was rejected unanimously by the Supreme Court.

Now the remaining charges are largely for trespass and unlawful entry into the Capitol. Yet, the myth will continue as a mantra in the media that this was an attempt to overthrow the government. …

I think the prosecutors that included this charge be disbarred and sued in court for their part in this. They had access to unlimited taxpayer funds and chose to destroy citizens of the US financially and some died due to the persecution. Judges who were part of this should be demoted and verbally and publicly reprimanded, it is a disgrace how they conducted their courtrooms against the people of this country. That is all I will say on these banana republic trials. Be safe trust in God and God bless.

Praise God and the Supreme Court Justices! Finally, we can now get to the wrongly accused people who were attending a peaceful protest. Many have received terrible treatment in the D.C. Gulag under the DOJ and this administration. Some committed suicide! What a crime against humanity! They will get due process which was stolen from them by the left.

I’m sorry that this writer was so naive as to believe that there ever was a riot of Trump supporters. It was clearly an inside job to intimidate honest conservatives and falsely imprison innocent people.

The saddest part is that five people killed themselves because of this, out of shame, out of despair, and we did not pray hard enough for them. Some of these men were in solitary confinement and beaten, and who knows what condition they are in. Pray for their healing, please Lord hear our prayer heal these people and bring justice to those responsible for setting this trap up for Americans. And your holy name, Lord

I agree with the Supreme court’s decision big time. This was all Democrats way of GT back at president Trump and follows of his. I believe all the people charged should be payed all their wages and court fees back by the Democrats .I hope no one can vote unless they show voter ID like I have all my life !

Jan 6th was a set-up. Some people got out of line. The majority didn’t. Police opened the doors and waived people in. Contrary to leftist media reports there were no police officers killed on Jan 6th. In addition, one police officer shot and killed a woman. She had no gun. He tried to cover that up. This has been a politically charged prosecution. Shame on our country.

Thank you, Father, for this decision. I pray the false narrative would be completed. This was not an unlawful entry or a trespass. Doors were opened on the inside and people welcomed in simply to set them up. May all truth come out and may justice finally be served! In our Savior’s name, Amen!

I’m VERY THANKFUL to the Lord for this decision (which was obviously wrong in the first place)
However, I’m still praying that the true initiators of the so called riot would be held accountable. That’s ANTIFA. I was there and saw the posters on the light polls by ANTIFA requesting folks to join them by getting a Trump hat and wearing it backwards. Then parading in single file thru the crowd to the front of the Capitol and setting off teargas and or smoke bombs and going through the barricades at the top of the steps…. The one officer at the top of the steps just let them in.
My group left the scene immediately and went around the crowd to the Supreme Court side of the Capitol to meet up with the rest of our peaceful group.

That whole January 6th ploy was staged and paid for by the democrat party led by Nancy Pelosi. All they had to do was make sure their paid for Antifa army showed up in red hats and create as much havoc as possible. This was the most “peaceful” insurrection in the history of the world. The initial people were trouble makers, the second wave were spectators taking pictures, following directions from guards, etc. There were no weapons, not even pitchforks. This has been an overblown, media driven display of liberal nonsense. There should be charges, but let’s make them just. Also, none of these people burned down police stations, destroyed businesses, or killed people as we all witnessed in our major cities.

I applaud the Supreme Court for their ruling. However, the people who entered through the doors of the Capitol were let in by the police. There’s plenty of video footage showing how they let people in. The ones who broke windows and tried violent acts were mostly Antifa, also proven by video footage. I really believe all the people who have been unjustly incarcerated without due process should be released without court trials. It saddens me that some unjustly held prisoners have committed suicide because of these false arrests. I continue to pray that the Lord’s Will be done for all those involved and to give strength to the families that have had to endure this tragic unfair imprisonment.

Awesome! Still not good enough for those who have been held in jail for over 3 years without being given a trial. Also, when the police are standing at a door ushering you in, are you supposed to know it is trespassing? I’m pretty smart and I wouldn’t know that. But I thank God for this ruling and this victory!

There wasn’t even trespass and unlawful entry since the capitol police were opening doors and ushering people in. There was destruction of property by some, however. If the justice department was fair this could slide also since they did not charge any of the far left thugs with this when destroying historic landmarks and statues.

    Praise God that the obstruction charges can now be invalidated! But yes, what about the video evidence of Americans being waved and ushered into the capital building? We can see Americans in lines who did walk in peacefully. Is that still considered “unlawful trespass”? And there still remains the burning question of who really instigated the riot??

    And where are the charges and outcry against the Antifa and Black Lives Matter rioters who destroyed national monuments, burned buildings down, and created months-long chaos in certain cities across America?
    Thankful for some justice done and for our Supreme Court upholding the laws of the land! Praying for the truth to win out in all matters! 🙏

Thanks be to God for this decision. It was late in arriving. The “insurrection” fiasco was a bogus charge by democrats to persecute the opposition party. The democrats of entered the Capitol building to protest in the past and were treated with respect. The treatment by democrats of their opponents is UnAmerican and unacceptable, and appears patterned after the CCP. May God bless America.

Exactly how is someone charged with unlawful entry when they were invited to come in? Anyone who can’t see that most of those people who were there were antifa themselves posing as Trump supporters including FBI agents posing as ridiculousness is not really looking clearly. Open your eyes people and ask God to see truth and reveal truth to you and remove the scales from your eyes and ears, including the person who wrote this article and literally said that’s what they should’ve been charged with. Give me a break.

The whole thing was done to prevent people from exercising their first amendment right and many others. All it was was to make people afraid to come to DC and protest, the coup of our government overthrowing a duly elected president, President Donald J Trump, and not this senile whatever you want to call him in the White House. He is a demonic, evil, wicked corrupt man and I will not pray for him either so don’t ask me to Justice needs to be served

Whatever happened to all the other rioters who literally burned down buildings and caused billions and billions of dollars of destruction. Nothing happened to them as usual.

Since Metro officers went throughout the Capitol lawn inviting Trump supporters to come inside the Capitol, I think the trespass charge should be dropped. There needs to be a true investigation, including the testimony of those being charged. And the charge of entrapment should seriously be considered. Unarmed Trump supporters were beaten and killed. There needs to be justice for them.
