Both South Dakota and Kansas have advanced constitutional amendments banning noncitizen voting. Will these proposed amendments make it through the state legislature and each state’s constituency?

The South Dakota Senate voted 33-2 on Tuesday for an amendment banning noncitizen voting.

Two days later, the Kansas House of Representatives voted 90-28 for a similar amendment to its state’s constitution.

The amendments would still have to be passed by the other chambers of the legislatures–which is likely since Republicans control the legislatures in these conservative-leaning states. After that, voters will decide. Each state requires a simple majority of the voters to pass a constitutional amendment. In other states, voters have approved amendments to ban noncitizen voting by 70% or more.

So far, 14 states have similar amendments to their state constitutions, eight of which were adopted in this past November election, according to Americans for Citizen Voting, an advocacy group. In most cases, voters approved the amendments by comfortable margins.

“We are thrilled by the quick action in Kansas and South Dakota,” Americans for Citizen Voting President Avi McCulluh said in a public statement. “We are hopeful for passage in the other chambers in these states.”

However, opponents insist it’s a waste of time. Cille King, a board member of the Kansas chapter of the League of Women Voters, told KSNT-TV News, an NBC affiliate in Topeka, that the law is already clear that only citizens can vote.

“HCR 5004 should be dismissed as a waste of time and taxpayer money,” she said. “The current language is clear that only citizens can vote. The new language does nothing to address any possible voter roll errors.”

King further argued that changing the wording in the amendment “removes the certainty of every citizen’s right to vote.”

The citizen-only voting amendments will not affect federal elections in these states, where it is already illegal for noncitizens to vote. Rather, the amendments are to prevent municipalities from allowing noncitizen voting.

Currently 21 local jurisdictions in California, Illinois, Maryland, New York, Vermont, and the District of Columbia allow noncitizens to vote in local races for school board, mayor, and similar offices.

Critics warn that allowing noncitizens to vote in local but not state or federal elections places a burden on maintaining two separate voter registration lists for election officials.

“There is a myth out there that foreign citizens are not voting in the United States. That is not true,” McCulluh of Americans for Citizens Voting said. “The media and our opponents frequently get that wrong. Even though it’s happening in our nation’s capital.”

As I noted in my book “The Myth of Voter Suppression,” foreign nationals have registered to vote and voted in past elections, as a matter of public record.

Americans for Citizen Voting helped campaign for successful citizen-only voting balloting initiatives in 2024 in Idaho, Iowa, Kentucky, Missouri, North Carolina, Oklahoma, South Carolina, and Wisconsin.

Voters approved constitutional amendments requiring citizenship to vote in Louisiana and Ohio in 2022, according to Ballotpedia. In 2020, voters approved similar constitutional amendments in Florida, Alabama, and Colorado. In 2018, voters in North Dakota approved such an amendment.

“This is the most dangerous time in our history since Washington crossed the Delaware Christmas night in 1776″. This is not a game , WE have had many threats to our nation along with threats against our President Trump and many representatives, and it’s people. The threat is so great we really need a dramatic change. America is in a crisis with news media that does not want to to uncover the truth about the fraud of voting. We appreciate the American for CITIZEN Voting -HCR 4005 that should clarify that only American Citizens are allowed to vote. In Genesis 1:26-28 it explains that He delegated a governmental rule of the small portion of His Kingdom Earth to this family. God’s intent was that ‘ALL earthly government be a conduit of HIM-” through goernmental authority -at every level-and do so through humans, His new family’s. ‘ THERE was one failure and that was Adam, when satan deceived and stole God’s family and the dominion government. God had to redeem and restore HIS plans, since satan became ruler in the earth. At this moment God had a solution ‘JESUS” had to become one of us and with his plan -we were made it possible to become God’s family again and through this we became part of God’s family again”( DS). In Matthew 28-18 it tells us all authority on earth is now His. Matthew- 16:18-19 tells us that Christ delegated His authority to us once again. In the 2024 elections states such as -KY., MO., NC., OK., SC., IDAHO, IOWA, WIS. had a sucessful citizen voting. They used their authority Jesus gave us. We are suppose to be following the Constitutional that has been directed by God and our forefathers. God we have prayed for secure elections, but in the Dems. states is not going to happen with all the sneaky things these states do along with fear to the people. God we need not be frightened by these elections, because we know regardless, if the churches have not done their part – You still have the remnant that is praying and speaking out for our security of having leagalized voting again. God, in Jesus name , on behalf of the church we ask You to forgive us for not representing You and Your ways as we should. please, breath on the awakening that is occuring, please cause it to increase -give them a heart for praying GOD;S word. Send the fire to the pulpits of America of America again and again. ‘WE release the AUTHORITY You gave us and bind demonic, evil plans of next elections that include DEMS, plans. That all of their plans done by them will fail and be no more. “Jesus release the power of Holy Spirit to oppose them” ” The wicked flee where no man pursueth; but the righteous are bold as a lion” roverbs -28-1

    They MUST come in legally.
    ILLEGALS MUST NOT VOTE in our elections because they are not legal citizens and do not represent us.
    Yes we love and care for immigrants. That’s why we have a pathway in place for them to come in! It’s not rocket science. We even love and care for the illegal immigrants but they must come in legally the right way and must NOT be given the right to vote until they’re legal and law abiding citizens.
