A growing storm is building in Washington as lawmakers express deep frustration over what they see as a disturbing lack of transparency from federal agencies entrusted with truth and accountability.

Despite the Biden administration’s repeated promises to be “the most transparent in history,” many of the major revelations surrounding the FBI’s Arctic Frost probe and Special Counsel Jack Smith’s 2020 election investigation into President Trump have not come from official disclosures—but from whistleblowers risking their careers to alert Congress and the American people.

Sen. Ron Johnson and Sen. Chuck Grassley, long-time advocates for government oversight, warn that the Department of Justice and the FBI appear to be withholding key materials, delaying releases, and in some cases delivering documents more heavily redacted than versions already provided by whistleblowers. Johnson believes partisan actors remain “burrowed” inside federal agencies, slowing cooperation or even “sabotaging” Congress’ oversight efforts. With investigations labeled by some senators as “bigger than Watergate,” the stakes continue to rise.

Lawmakers describe two major barriers: DOJ’s slow internal reviews—exacerbated, they say, by political targeting of attorneys willing to defend Trump—and the challenge of obtaining grand jury materials that must be unsealed by court approval. Meanwhile, senators accuse certain officials of attempting to keep Congress in the dark through nondisclosure orders, withheld records, and slow-rolled document production.

Whistleblower releases have repeatedly outpaced federal transparency. Smith’s seizure of President Trump’s government-issued phone, for instance, became public through Congress months before the DOJ acknowledged it. And even then, the DOJ’s eventual disclosure redacted more than the whistleblower-provided version. Troubling revelations of burn bags containing records related to high-profile investigations—including Mar-a-Lago, January 6, and the Durham probe—have raised further concern about potential destruction of evidence.

While the DOJ insists it is working “diligently” to provide information, senators across multiple committees say the pattern of delay, redaction, and obstruction points to a deeper problem: a federal apparatus resistant to scrutiny and potentially weaponized for political ends. Many are now preparing for Watergate-style hearings once the necessary documents are obtained.
