The Islamic Society of Tulsa has filed a federal lawsuit against the city of Broken Arrow, Oklahoma, after local officials rejected plans for a new mosque and Islamic community center. The legal battle raises questions about religious land-use protections, local authority, and the federal government’s role in reviewing the city’s decision.

According to the lawsuit, the Islamic Society purchased roughly 15 acres in Broken Arrow in 2014 with plans to develop a mosque, community center, and commercial space. The organization eventually sought rezoning and a conditional use permit necessary to move forward with the project.

City planning staff and the Broken Arrow Planning Commission reportedly recommended approval of the proposal. The City Council, however, voted 4–1 in January to deny both the rezoning request and conditional use permit.

The Islamic Society now alleges that the rejection amounted to religious discrimination. Its lawsuit names the city and four council members and argues that officials violated the First and Fourteenth Amendments, the federal Religious Land Use and Institutionalized Persons Act (RLUIPA), and Oklahoma law.

Central to the complaint is the allegation that Broken Arrow treated the proposed mosque differently from comparable Christian churches and commercial developments. The Islamic Society claims other applicants were permitted to address traffic, engineering, and infrastructure concerns after receiving approval, while its project was rejected outright.

The lawsuit also points to public opposition surrounding the proposed development, arguing that hostility toward Islam influenced the council’s decision. The city has reportedly declined to comment on the pending litigation.

The controversy has now drawn the attention of the Trump administration. The Department of Justice has opened an investigation into whether Broken Arrow’s decision violated federal protections governing religious land use.

That investigation has prompted pushback from Oklahoma Attorney General Gentner Drummond, who has urged the administration to end the federal inquiry. Drummond characterized the DOJ’s involvement as federal overreach and argued that zoning and land-use decisions should remain primarily in the hands of state and local authorities.

RLUIPA, enacted by Congress in 2000, places limits on how local governments can apply zoning regulations to religious institutions. Among other provisions, the law prohibits governments from imposing land-use regulations that discriminate against religious assemblies or treat them on “less than equal terms” compared with nonreligious institutions.

The dispute could therefore become a significant test of two competing concerns: the authority of local elected officials to make zoning decisions for their communities and the obligation of government to apply those rules without discriminating on the basis of religion.

It’s also important to remember what these mosques symbolize for adherents of the Islamic faith. As IFA has covered and explained previously, Muslims see the construction of mosques as a way to claim territory in America. Should the state of Oklahoma be forced to allow the construction of this mosque in the name of “tolerance” and “religious freedom” even though the construction symbolizes something much darker?

As this case moves forward, let’s pray for wisdom for local, state, and federal officials as they navigate religious liberty, community concerns, and the proper limits of government authority.
