DOJ Opens Criminal Probe Into Dobbs Leak
The Justice Department has opened a criminal investigation into the 2022 leak of the Supreme Court’s draft opinion overturning Roe v. Wade, more than three years after the court’s own investigation failed to find the person responsible.

From Fox News:
The leak that exposed the Supreme Court’s draft opinion overturning Roe v. Wade is under criminal investigation by the Department of Justice, years after the court’s own hunt for the culprit came up empty.
U.S. Attorney Jeanine Pirro’s Washington office is leading the probe, multiple sources briefed on the matter told Fox News.
…
“It was a grave breach of the trust that everybody who worked in this building had before that point,” Alito added. “And it very predictably made the five of us in the majority targets for assassination and nearly resulted in the assassination of my colleague Brett Kavanaugh.”
According to Fox News sources, the investigation has been underway for at least a year, and grand jury subpoenas have been issued, though it is not clear who received them. The New York Times first reported the probe. Justice Samuel Alito, who wrote the Dobbs majority opinion, told Fox News last month that he has a suspicion about who leaked the draft. He said the evidence is not yet strong enough for him or the court to name that person.
The court’s own investigation came up empty. After Politico published the draft on May 2, 2022, Chief Justice John Roberts assigned Court Marshal Gail Curley to find the source. Her team interviewed nearly 100 employees and examined court devices, networks, and phone logs. In January 2023, the court announced it could not identify the leaker. Investigators had narrowed their focus to roughly 70 people with access to the draft, including about three dozen law clerks, most of whom have since finished their clerkships. The marshal’s report found that pandemic-era work-from-home arrangements and gaps in security made it easier to remove sensitive material. It also found that some employees admitted telling a spouse or partner about the draft.
The consequences of the leak were severe. Protesters gathered outside justices’ homes, and in June 2022 a California man was arrested near Justice Kavanaugh’s Maryland home and charged with trying to assassinate him. IFA President David Kubal has written about how intercessors prayed by name for the justices and their clerks throughout the Dobbs case, and how God intervened to stop that assassination plot.
“For nothing is hidden that will not be made manifest, nor is anything secret that will not be known and come to light” (Luke 8:17). Let’s pray that God would bring the truth about this leak into the open, and that the person responsible would be identified and held accountable under the law. Let’s pray for U.S. Attorney Pirro and her team, that they would pursue this case with wisdom, integrity, and diligence. Let’s pray for protection over every justice and their families, and that trust would be restored within the Court. And let’s pray for the person who leaked the draft, that conviction would lead them to come forward and repent.
