Late Tuesday, federal district judge Emmet Sullivan issued a bizarre order, inviting third-party groups with no legal interests in the case to file amicus briefs addressing the Justice Department’s motion to dismiss the false-statements charge against Michael Flynn, President Trump’s former national-security adviser.
The cantankerous jurist is stoking opposition to the dismissal. He knows the law calls for him to accede to attorney general Bill Barr’s decision. . . .
Flynn’s counsel relates that on 24 prior occasions, Judge Sullivan has summarily refused to entertain input from non-parties to the case. No federal criminal rule authorizes such interventions. Yet Sullivan now encourages them.
There is no complex legal issue to be resolved. DOJ’s dismissal motion may be politically controversial, but legally it is pro forma. The only branch of government constitutionally authorized to proceed with a criminal prosecution is the executive. The Justice Department has declined to prosecute. There is nothing for the judge to do besides the ministerial task of ending the case on the court’s records. . . .
If there is anything legally dubious here, it is the proposition that a judge may deny a dismissal motion filed by the Justice Department. Rule 48 of the Federal Rules of Criminal Procedure purports to require “leave of the court” before prosecutors may dismiss an indictment. Yet a statutorily enacted rule cannot amend the Constitution, which vests solely in the executive the power to prosecute.

The federal judge overseeing the criminal case against former national-security adviser Michael Flynn is weighing charges of perjury or contempt for Flynn even as the Justice Department seeks to have the case dismissed.
Judge Emmet Sullivan said he has appointed a former federal judge to argue against the Justice Department’s controversial move to dismiss the case against Flynn . . . .
Sullivan said Tuesday he will allow third parties to weigh in on the case before dropping the charges and directed a retired judge, John Gleeson, to recommend whether Flynn should receive a criminal contempt charge for perjury. Sullivan’s order directs Gleeson to determine whether Flynn’s admission that he lied to the FBI, which was made under oath on two separate occasion, amounted to perjury, since he later reversed himself and said he never lied to the agents.
Gleeson, a Clinton appointee who served as a federal judge in New York, has expressed suspicion that the DOJ’s move was tainted by political influence.
“Government motions to dismiss at this stage are virtually unheard of,” Gleeson wrote along with several other authors in a Washington Post op-ed published Monday. “There has been nothing regular about the department’s effort to dismiss the Flynn case. The record reeks of improper political influence.”

This case, and Attorney General Barr and his team, need our continued prayers. General Flynn’s case is not over and it may be more political than ever.

This is so grievous and unfathomable that elected and appointed persons given the trust and promised to obey the Constitution would stoop so low out of untamed desires for power. Each of them need to be charged with a violation of their positions, leveling false charges, lying witnesses and principals should all be indicted and arrested. We must stop allowing any of them to ever hold a government office, or we will lose this Republic. “God is not mocked, whatever a man sows, that shall he also reap” Well, they sold contrived and dishonest charges. We pray they are all removed from D.C. never to hold a government position again, plus big fines and/or jail time.
That judge should lose his license. God, we pray that you will vindicate the wonderful public servant General Flynn completely. Amen

Thank you for your comment. However, it has nothing to do with what I said. I am not pointing my finger at anyone. My question is why plead guilty to a crime you did not commit? Read again Matthew 12:37. This is God’s Word. Not mine.
I don’t know where Michael Flynn is spiritually, but I see that he is in the midst of a spiritual battle that is larger than himself and his own family. Lord, give him eyes to see the war in the spiritual realms and the understanding to call on you for the weapons he needs to confront these strongholds. Empower Sidney Powell and others engaged in this fight on behalf of the American people and justice.
Father God, the God of justice and righteousness, we come before You on behalf of the Flynn case. First we ask for Your hand of protection over Gen. Flynn, his family, Sidney Powell & her legal team, AG Bill Barr & his team. We yearn for Your justice to be done on earth as it is in heaven. It is very clear that there is “a fix” in this case and that there is a star chamber in action here. Using the keys of the kingdom that Jesus gave us, we bind the forces of injustice, bribery, blackmail, threats, corruption, & evil in the name of Jesus Christ and in His authority when He prevailed against satan at Calvary. We loose in the name of Jesus Christ, truth, justice, righteousness, and the revelation of the corruption at work in the shadow government. We know that no weapon that is formed against Your will can prosper. We know that greater are You who is in us that he who is in the world. We appeal this case to the Supreme Judge of all that You would render Your verdict on the anti-Christ forces at work in this case, as well as in so many other venues in our government. The battle is not with Judge Sullivan as it is with those rulers, powers, and anti-God forces that have stepped in to control him. We ask that You would remove from the bench all judges who are similarly in a position where dark forces are dictating their unrighteous decisions. Our eyes are fixed on You. You can take what the enemy means for evil and turn it for Your purposes. We cry out, “May Thy will be done on earth as it is in heaven. So that all the glory is Yours. Hear our prayers, Father, and redeem this case to demonstrate Your righteous justice before a watching world. Strengthen Gen. Flynn and Sidney Powell with endurance to finish strong. We uphold them in our prayers.
This is how the feds do it. They tell you their high rate of convictions, 98% or whatever it may be. Then they tell you that if you go to court, they will put you away for a very long time or go after a family member, etc. BUT if you plead guilty, you may get out before you die, and they will leave your family alone. There is no small number of people sitting in jail because of these standard practices. The lid needs need to be ripped open to facilitate genuine reform and many people need to be set free and have their records expunged.
Father we pray for Judge Sullivan that you would help him to come to know You, Jesus, as his Savior. Father that through Your Precious Son Jesus this judges’ heart would be broken and that he would turn away from ruling in an unjust way. Father I pray for You to intercede on behalf of General Flynn. Please let the truth be known. Shine Your light and reveal any lies so that justice will prevail. Please give General Flynn’s attorneys wisdom and favor in dealing with this new problem. Father, please stop those who are trying to turn this country away from You, destroy President Trump and His cabinet and advance evil in American. Rather I pray that the principles that this nation was founded on; ” One nation under God” would once again be restored and there would be great revival in this nation. We thank You Father for Your merciful love and help in every situation.
Father- In the Name of Jesus we ask for protection and for this not to be allowed to hinder the justice department from doing what it is supposed to do – follow the evidence. Please vindicate this man and help him to speak with utmost truthfulness resting his case into your hands. help him to turn to you in his hour of need. Help the legal counsel to be able to defend him against yet another unprecedented move. We need You- Your mighty hand- Your mighty power to be our defense.
Father, I pray for the removal of ALL unjust judges that would go against the laws that you gave and the constitutional laws of the land. I ask for THRUTH and JUSTICE to prevail over all the works of the enemy and every case that is brought before judges in the mighty name of Jesus.
Heavenly Father, God of Justice we beseech Your judgement upon Judge Sullivan and any other judges who attempt to illegally obstruct Your justice and will for General Flynn. I declare that Judge Sullivan and others who side with him are held in contempt of the court as violators of our Constitution, that they are punished by our legal system and are personally accountable and judged by You for their rebellion. I decree that they lose their credibility, their license to judge, their freedoms and be confined to prison. What harm they Inflicted and further intended for General Flynn would happen to them 7 times worse because You are God, the Almighty Righteous Judge. Your will shall be done with justice with full pardon and exoneration for General Flynn. No one can obstruct Your will. Be it so in Jesus’ name. Amen
