A federal appeals court ruled Friday that President Donald Trump’s “invasion” declaration at the US-Mexico border was illegal, paving the way for the resumption of asylum processing, The Washington Post reported.
On the first day of his second term, Trump issued a proclamation effectively shutting down asylum at the southern U.S. border, stating it would remain in place “until I issue a finding that the invasion at the southern border has ceased.”
“We conclude that the INA’s text, structure, and history make clear that in supplying power to suspend entry by Presidential proclamation, Congress did not intend to grant the Executive the expansive removal authority it asserts,” the court wrote.
The ruling centers on whether the executive branch has the authority to broadly suspend asylum under existing immigration law. While the Trump administration argued that the situation at the border constituted an “invasion” requiring decisive action, the court found that such authority must be clearly granted by Congress. This legal clash highlights ongoing tensions between branches of government over immigration policy.
The policy had led to a dramatic drop in illegal crossings, with monthly encounters falling far below previous levels. Supporters argue that restricting asylum removed incentives that fueled mass migration, while critics maintain that asylum protections are a legal and humanitarian obligation. With the administration expected to appeal, the final outcome remains uncertain, but the decision could reshape border policy moving forward.
