Court Backs Trump on Migrant Parole Program
A major federal court decision has cleared the way for President Trump to end the special protected status granted by the Biden administration to roughly 430,000 migrants from Cuba, Haiti, Nicaragua, and Venezuela.

The ruling comes after a Biden-appointed judge, Jia Cobb, blocked the policy reversal in early August, arguing that removing CHNV protections would inflict “irreparable harm” on migrants by separating families and forcing people to return to dangerous conditions.
However, the 1st U.S. Circuit Court of Appeals disagreed, stating that while hardships may exist, they do not outweigh the federal government’s legal authority to enforce immigration policy. The judges emphasized that plaintiffs had not demonstrated a strong likelihood of success in proving the administration exceeded its discretion under the Immigration and Nationality Act.
The Supreme Court weighed in as well, issuing a 7–2 decision to stay the lower court’s order while the case proceeds through appeal. This means Trump is legally permitted to end the parole pipeline immediately, pending a final outcome. Justices Ketanji Brown Jackson and Sonia Sotomayor dissented.
The Trump administration argued that leaving the parole program intact would undermine critical immigration policy, weaken border security, and undo the will of the American people expressed in the last election. The Court’s decision underscores the constitutional role of the Executive Branch in setting and enforcing immigration rules—something the administration contends is vital for sovereignty and national security.
This ruling signals that the courts recognize the president’s constitutional authority to protect the border, even in the face of challenges.
