The Occupational Safety and Health Administration suspended work on President Biden’s vaccine mandate after a federal appeals court hit pause on rules that would force companies with 100 or more employees to require COVID-19 vaccinations or regular testing for coronavirus infection.
OSHA said the 5th U.S. Circuit Court of Appeals’ decision to stay the mandate forced its hand but that the fight over Mr. Biden’s rule, or emergency temporary standard (ETS), isn’t over.
“While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation,” the agency said on its website.
The 5th Circuit froze the mandate late Friday, citing “a multitude of reasons” to believe that a legal challenge is “likely to succeed on the merits.” OSHA’s decision to stop its work went largely unnoticed until Wednesday.
The suspension was the latest reminder of the fault lines around Mr. Biden’s decision to reach into the private sector and require big employers to ensure that their workers are vaccinated by Jan. 4 or are tested for the coronavirus at least once a week.
The regulation has sparked dozens of lawsuits and pushback from business groups, which say they don’t want to wrangle with their employees on the cusp of the holiday season and can’t afford to lose workers in a tight labor market.
Employers aren’t required to develop a roster of vaccinated and unvaccinated employees until early December, and the testing rules don’t kick in until the new year. Even so, challengers celebrated OSHA’s suspension as a sign that the mandate is teetering and they should accelerate their efforts as the fight pivots to the 6th U.S. Court of Appeals.
“While I am pleased with the actions taken by the court and that OSHA has subsequently suspended President Biden’s unconstitutional vaccine mandate for now, I will continue fighting to put a full stop to his efforts to fire Americans for choosing to not get the vaccine,” said Sen. Roger Marshall, Kansas Republican. “Joe Biden’s mandate is a slap in the face to so many people, including our essential workers, who answered the call last year. These are real people working to feed their families and pay their mortgages.”
Mr. Marshall, all 49 other Senate Republicans and more than 160 House Republicans backed a disapproval resolution Wednesday that would use the Congressional Review Act to quash the OSHA regulation. Though it is unlikely to succeed, the push will force Democrats to vote either in favor or in opposition to the mandate.
Meanwhile, the federal government is expected to ask the 6th Circuit to lift the stay imposed by the 5th Circuit as the fight inches closer to the U.S. Supreme Court.
“The Sixth Circuit can either lift the Fifth Circuit’s stay or leave it in place. But if the Sixth Circuit leaves the stay in place, then the Biden administration will go to SCOTUS quickly,” Josh Blackman, a professor at South Texas College of Law, said in an email in reference to the high court.
Missouri Attorney General Eric Schmitt, a Republican, highlighted the 6th Circuit showdown as he took a victory lap Wednesday on OSHA’s decision to pause the mandate. . . .
Under the OSHA standard, covered employers would need to take stock of which of their employees are vaccinated or not by Dec. 5. Unvaccinated employees would need to wear masks at the workplace and submit to testing at least once a week as of Jan. 4.
The OSHA regulation applies to 84 million workers. Though many of them are likely immunized already, OSHA estimates that the rule would compel 23 million people to get vaccinated.
Republicans, business groups and religious liberty advocates say the rule is an unprecedented overreach into Americans’ medical decisions and stretches OSHA’s authority over workplace safety.

I was encouraged after the court made the ruling to stay OSHA from going along with the mandate. However, it seems this administration has a pass on obeying the 5th Circuit Court’s ruling as well as their defiant disobedience to SCOTUS regarding the Stay In Mexico ruling. Yesterday, Jen Psaki even said they plan on continuing with their plans to mandate the jabs. How is it that no one in this administration is held accountable for their actions?

It is important that we do rejoice, however we need to continue to pray for this mandate to be completely over. Everyone should be given the right to choose and not be forced to take a shot that they don’t want. Whatever happened to HIPPA privacy?

find it amazing that this “virus” seems so selective and smart. I have attended a number of dinner affairs over the last couple months where attendees were required to wear mask upon entry(thank God for no proof of vaccine). The conversation around the tables was rather somber because we had to socially distance. Upon the food being served, we were allowed to take off mask, and the the atmosphere became somewhat festive with people talking and laughing. Nobody returned to their mask and afterwards people mingled and began to act “normal.” Why the difference? Did the virus suddenly know to not invade at a certain time and level of the atmosphere (smile!)? Or was it that the perceived and orchestrated fear dissipated in the minds of the people in attendance? IThis folks is brainwashing and many have fallen for the lies of the enemy.
Father God: We especially, Your Body, need to be renewed in our minds so that every day we wake up we walk in joy, love with a sound mind. Your Word of peace (nothing missing, nothing broken-SHALOM) has to invade our mind and our heart so that we don’t mechanically (as robots) go about our day but purposely assess the actions and words that we speak. We must not allow fear to dictate our actions but allow faith to be the last Word on everything we do. I especially pray for those Saints who are working for the CDC, FDA, and NIMH, that their consciences would be seared and they would not simply go along to get along but would whistle blow till God told them to stop. We pray for their boldness and protection. I pray the same prayer for those Saints working in social media, be it TV, internet, radio, newspapers because they have helped to perpetuate the lies. Lord, let your Spirit of Revival clear out the lies and let the Truth prevail that has set up.

Unfortunately my husband’s employer is steamrolling over employees and moving forward as if this ruling was in place. Word just came down today that employees are to comply as if it were law.
Melissa I’m sorry to hear this is absolutely insane. Please tell him not to comply let his work fire him over this his employer will lose many valuable employees. What state are you in if I may ask?
If we stand up against these regulations by power hungry officials, they cannot put us all in jail. They cannot run their businesses, or hospitals, or salons or anything without employees. That was the basis of forming unions to begin with ( though they got out of control with power) WE THE PEOPLE are the power, let us use it without fear. I am thankful for this ruling. But there needs to be a ruling that businesses cannot force the issue on their own. People are still being fired because businesses have taken up the “mantle”.
I pray that there is a ruling against discrimination with hefty fines for discriminating against the unvaccinated.

We can only give thanks to God in Christ who gave wisdom and reason to the Supreme Courts. He knew ahead of time of whom should be there so the lives of people can be saved from destruction from the rebellious evil communists.

Father, 84 million workers, 23 million w/o shot…I lift the 61 million with it. Jesus, we have so many telling of its danger to health and DNA. Have mercy gracious Father on the lives of these people and their elders and children. If the chatter is true about changing DNA we are in a very dangerous time! Only You can do the impossible to save so many people from the snares of our enemy and Your enemy. Have mercy and save us from the corruption boiling up daily, hourly to defraud us of life, liberty and the pursuit of happiness You alone inspired in our founding fathers. Please pray for all those still affected by mandates. Even though OSHA is taking a pause, some large corporations are pushing ahead with their corporate mandates affecting many employees. Lord, we ask you to guide these corporations to also take a pause in enforcement of mandates. Please draw the attention of their executives to important facts and news they need to see, and give them wisdom. Let these corporations be guided by your Holy Spirit. Protect the men and women of these corporations from harmful effects, whether job loss or adverse effects of vaccines. Give them wisdom in their decisions as you also give wisdom to corporate leaders. Thank you for your faithfulness and your mercy, and your provision for your people.

But please pray that those State with Democrat Gov. Do Not Try to implement same thing on there people. Or that the schools/businesses do not try to implement these unconstitutional policies.
(A school in our area is looking at doing just that with it’s employees-as soon as the news broke about the mandate/OSHA-they had an emergency meeting to try to control the C spread -but just the day before[before stop of OSHA Mandate]they had said to their employees they were waiting to see what transpires with mandate before requiring V X and or masking.
Still an item for prayer that states and businesses DO NOT go forward with it anyway!
