You are part of this major win for free speech. The Supreme Court ruled that Colorado unlawfully required a web designer to create websites that are inconsistent with her religious beliefs. From The Christian Post. The United States Supreme Court has ruled that Colorado cannot force a Christian website designer to create websites celebrating same-sex marriage.

In a decision released Friday morning in the case of 303 Creative LLC v. Elenis, the high court ruled 6-3 that Lorie Smith of 303 Creative could not be compelled by state civil rights law to make websites that go against her sincerely-held religious beliefs.

Justice Neil Gorsuch authored the opinion of the court, being joined by Chief Justice John Roberts and Justices Clarence Thomas, Samuel Alito, Brett Kavanaugh and Amy Coney Barrett.

Gorsuch wrote that “no public accommodations law is immune from the demands of the Constitution” and expressed concern over the state’s attempt to control Smith’s speech.

“Under Colorado’s logic, the government may compel anyone who speaks for pay on a given topic to accept all commissions on that same topic—no matter the underlying message—if the topic somehow implicates a customer’s statutorily protected trait,” wrote Gorsuch.

“Equally, the government could force a male website designer married to another man to design websites for an organization that advocates against same-sex marriage … As our precedents recognize, the First Amendment tolerates none of that.”

Gorsuch went on to note that “commitment to speech for only some messages and some persons is no commitment at all” and that “the opportunity to think for ourselves and to express those thoughts freely is among our most cherished liberties and part of what keeps our Republic strong.”

Justice Sonia Sotomayor filed a dissenting opinion, being joined by Justices Elana Kagan and Ketanji Brown Jackson, claiming that the majority “grants a business open to the public a constitutional right to refuse to serve members of a protected class.”

“The business argues, and a majority of the Court agrees, that because the business offers services that are customized and expressive, the Free Speech Clause of the First Amendment shields the business from a generally applicable law that prohibits discrimination in the sale of publicly available goods and services. That is wrong. Profoundly wrong,” Sotomayor wrote.

“[Colorado’s law] targets conduct, not speech, for regulation, and the act of discrimination has never constituted protected expression under the First Amendment. Our Constitution contains no right to refuse service to a disfavored group.”

In 2016, Lorie Smith of 303 Creative filed a pre-enforcement challenge to the Colorado Anti-Discrimination Act, arguing that the law would force her to offer services that violated her sincerely held belief that marriage is a union between one man and one woman.

A three-judge panel of the U.S. Court of Appeals for the 10th Circuit ruled against Smith in July 2021, with the two-judge majority concluding that “Colorado has a compelling interest in protecting both the dignity interests of members of marginalized groups and their material interests in accessing the commercial marketplace.”

“When regulating commercial entities, like Appellants, public accommodations laws help ensure a free and open economy,” said Circuit Judge Mary Beck Briscoe, a Clinton appointee, in the majority opinion.

“Thus, although the commercial nature of Appellants’ business does not diminish their speech interest, it does provide Colorado with a state interest absent when regulating noncommercial activity.”

Tenth Circuit Chief Judge Timothy M. Tymkovich, a George W. Bush appointee, wrote the dissent, saying that the U.S. Constitution “protects Ms. Smith from the government telling her what to say or do.”

“But the majority takes the remarkable — and novel — stance that the government may force Ms. Smith to produce messages that violate her conscience,” Tymkovich wrote.

“In doing so, the majority concludes not only that Colorado has a compelling interest in forcing Ms. Smith to speak a government-approved message against her religious beliefs, but also that its public-accommodation law is the least restrictive means of accomplishing this goal. No case has ever gone so far.”

In an opinion column published by Real Clear Religion a few months after the panel decision, Smith argued that the ruling against her showed that “the courts are even more open than many of us realized to letting officials punish religious freedom and silence free speech.”

“Incredibly, the majority even decided that – as a person of unique, distinctive creative skills – I constitute a monopoly. And, as a monopoly, I have no legal right to retain my artistic freedom,” Smith added. “The more unique my speech becomes, the more power the government has to regulate it.”

“Imagine telling Taylor Swift that she has to warble whatever lyrics the government directs her to sing because no one writes songs quite like she does.”

Smith appealed her case to the Supreme Court, which heard oral arguments last December.

Thank you Father for the one woman who stood up for the truth, Judge Barrett, while the other three women like Eve choose to side with satan and his lies. We pray that the heart of these 3 would be pierced with the light of your truth and they would come to know You. Just as the Mama Bears have raised up to defend their children from the onslaught of the enemy, let these women experience a Saul transformation and step into the role of Judge Deborah, who desired righteousness and justice. Like Lorraine..I find it confusing..in that sotomeyers argument sounds like a conservative mindset..and three splitting of crosshairs is mindnimbing..although realizing intellectual prowess governs complicated disputes..but it seems that the george W. appointee justice that dissented in Mrs Smith oroginal case said it most clearly..” the government has no authority to tell someone they must violate their beliefs to satisfy someone elses convictions” ..and I would add..especially on their own property in their own business..let the special interest group client go to another business/ service provider.
Lord I pray that when You draw men and women unto yourself ..that we would return to sanity in our country- in seeking you and being immersed in your word.. that our nation could be healed Lord.

Boy, I can hardly understand what is going on, here. What I do grasp is, folk would object mightily if a wholly LGBT advertising company would be forced (by the same logic used on Ms. Smith) to portray anti-LGBT issues, if a consumer asked them to.

Today is a joyous day for Christians and conservative thinkers. The old conservative guard were called “Federalists”, and they are largely accredited to winning the Civil War and liberating Blacks. Yes, slavery is a painful and ugly stain, one that I wish America could say it never participated in (especially considering the language of the Constitution and Declaration of Independence).

But, it must be called out that Democracts and Democrats alone want to fan the embers of this painful past. They fought to keep their slaves in the mid-19th Century and lost to the North (the Federalists under President Lincoln’s leadership). At the time of Ulysses S. Grant’s election to the presidency, white supremacists were conducting a reign of terror throughout the South. In outright defiance of the Republican-led federal government, Southern Democrats formed organizations that violently intimidated blacks and Republicans who tried to win political power.

The most prominent of these, the Ku Klux Klan, was formed in Pulaski, Tennessee, in 1865. Originally founded as a social club for former Confederate soldiers, the Klan evolved into a terrorist organization. It would be responsible for thousands of deaths, and would help to weaken the political power of Southern blacks and Republicans.

So, one could argue will we ever recover from the horrors of American slavery, but to be intellectually honest should also argue that Conservatives have a constant battle in fighting for Christian values- which when pure are inherently anti-racist anyway because Christians understand that God created all beings regardless of the pigmentation of their skin.

    I’m black, and yes we have already recovered from the stain of slavery! After all everyone on earth is descended from Noah and his 3 sons, Shem, Ham, and Japheth! Until obama hit the scene, our country was doing great in ignoring race and seeing people instead! The democrats have no platform or anything else to offer our country positively so they keep fanning the flames of black inferiority and lack of position! They do this to keep an underclass of black voters and white guilty voters! My parents never taught us that we couldn’t achieve because of skin color. Nor did I believe mean acts committed against me were because of racism. Some people are just mean! FATHER GOD please let us never be a respecter of persons just as YOU aren’t! Instead let us love all people unconditionally in JESUS NAME! Amen!

    And- according to what I remember David Barton teaching..Americac was about 3rd or 4th in the world- in. outlawing slavery in about the early 18th century.. approximately. That being in a era when the whole world practice slavery almost.. as much in the world does now.. and it must be noted that yes we were founded on Christian principles –although it takes time for that to develop and to Blossom -much as a person’s personal walk with Christ takes time to develop.. given the internal conflicts within the church in those days about various matters- much as today

We lift the 3 judges that opposed this ruling. They are blinded by the lies of the evil forces and don’t know what they don’t know. We ask You to point Your finger at those forces and we bind them. We loose these three judges to having eyes and ears to see and hear spiritual Truth and discern lies and therefore be better equipped to make the more moral decisions.
