An appeals court smacked down on Tuesday a judge’s sweeping attempt to investigate top Trump administration officials as a “clear abuse of discretion.”

Judge James Boasberg, an Obama appointee, planned to hold contempt hearings to assess whether officials willfully ignored his order to return alleged members of the Tren de Aragua gang to the United States, even if it meant turning planes around.

“The district court proposes to probe high-level Executive Branch deliberations about matters of national security and diplomacy,” D.C. Circuit Judge Neomi Rao, a Trump appointee, wrote in the court’s 2-1 opinion.

This ruling underscores growing tensions between the judicial and executive branches, particularly when it comes to immigration and national security. By stepping in, the appeals court signaled that lower courts do not have unlimited authority—especially when their actions risk interfering with sensitive executive decisions involving diplomacy and public safety.

The case also highlights broader concerns about judicial overreach. The attempt to probe internal deliberations of the executive branch raises serious questions about the proper limits of judicial power and the need to preserve the constitutional balance between the branches of government.
