A newly released America First Legal (AFL) report reveals that the October 4, 2021 “Garland memo” – which labeled concerned school board parents as “domestic terrorists” – was not a routine law enforcement action but a politically motivated operation orchestrated between the Biden White House and the Justice Department.

Key internal emails show that on October 1, 2021, DOJ staff scrambled to find a “federal hook” after the National School Boards Association’s complaint, while the White House actively sought DOJ involvement. DOJ career attorneys across the Civil Rights Division repeatedly pushed back, emphasizing there was no legal basis to target parents peacefully exercising their First Amendment rights.
Despite clearly expressed concerns—“nothing remotely federal” and “the speech is protected by the First Amendment”—political appointees advanced the memo over internal dissent. Emails from Sparkle Sooknanan and others show a weekend rush to prepare a memo, ignoring DOJ lawyers’ advice and bypassing normal legal review.
AFL President Gene Hamilton described the memo as “a conspiracy … aimed at depriving parents of two fundamental rights—the right to speak, and the right to direct the upbringing of their children,” stating it was timed to influence the Virginia gubernatorial election and broadly chill dissent. Vice President Dan Epstein and Senior Advisor Ian Prior echoed this, pointing out that the memo’s publication silenced parents under the guise of a law enforcement response.
In breaking this timeline – including internal caveats against action – AFL claims a major victory: proving the memo was intentionally politicized and coordinated with the White House. The report closes a chapter that AFL says began with a call for investigation and military‑style suppression of citizen speech, culminating in an unprecedented federal assault on parental rights. AFL vows to continue pursuing accountability for those who weaponized the DOJ against everyday Americans.

Heavenly Father, we thank You that You are at work uncovering and laying bare the twisted and intentional deceptive tactics used against parents within this nation. None of which was in the best interest for our children. We are not defined by Merrick Garland, the former White House Staff, nor the corrupt DOJ representatives that participated in this shameful deceit. Thank You for those who spoke the truth. The only way that this becomes more than political mud slinging, is if it is given teeth – by righteous prosecution, by enactment of just laws, by strict and enforced guidelines for agencies and governing bodies, etc. etc. Exposure falls far short of establishing justice and righteousness, which are the foundations of Godly governance. A bit like saying to a lawbreaker, “We know what you did, and we have all of the evidence against you, but we’re not going to do anything about it – we’ll just expose you!” That doesn’t satisfy Your justice, does it YHVH?! Please act on Your own behalf, if man does not!
