Prayer for numerous court cases outlined below are building momentum for an end to vaccine mandates as they advance throughout the United States judiciary branch—challenging the right of the federal government to mandate Covid vaccines to over 100 million Americans who must choose between taking an Emergency Use Authorization (EUA) Vaccine or lose their job.  These vaccine mandates are having dramatic impacts on every sector of our economy, including healthcare workers, federal contractors, federal government workers, military service members, private employees, and businesses.  As a result, average citizens around the world are marching in record numbers on their nations’ capitals to demand an end to mandates.

On January 23, 2022, two days after the March for Life in Washington, D.C., a “Defeat the Mandates – an American Homecoming” march and rally will start at 11:30 AM EST at the Washington Monument and proceed to the Lincoln Memorial, where featured speakers, artists, and musicians will seek to carry this momentum forward.  Organizers hope that  “Defeat the Mandates – an American Homecoming” will help bring about new federal, state, and local policies to eliminate the blatant discrimination and censorship currently taking place.

Thanks to your support and prayer, in December IFA filed an Amicus Brief in this most recent Supreme Court case to challenge the Biden Administration’s ability to force vaccine mandates on over 100 million Americans.  We were joined by several other organizations in this brief.

This Thursday, thankfully, the Supreme Court weighed in, upholding a restraining order, temporarily stopping the Occupational Health and Safety Administration (OSHA) from requiring private businesses with more than 100 employees to vaccinate their employees in compliance with the new OSHA rules. On a more challenging note for our frontline healthcare workers, the court ruled separately in a 5-4 decision that the Centers for Medicare and Medicaid Services (CMS), under the Department of Health and Human Services, has the authority to mandate vaccines for healthcare workers across the country.

The following lower court case had put pressure on the Supreme Court to act. They extended a temporary restraining order nationwide that prevented the Biden Administration from mandating vaccines to healthcare workers.  Judge Terry A. Doughty presided over STATE OF LOUISIANA ET AL CASE NO. 3:21-CV-03970 VERSUS XAVIER BECERRA ET AL HHS from the United States District Court, Western District of Louisiana, Monroe Division.

The case that initially stopped OSHA from being able to force private employers with over 100 employees to mandate vaccines was BST Holdings, LLC v OSHA, decided in the 5^th Circuit Court of Appeals. Shortly thereafter, the 6^th District Court of Appeals determined that the court could not extend the restraining order nationally, which led the Supreme Court to take the case.

On a sad note, over the past several months we have witnessed record numbers of Americans quitting their jobs in response to these mandates as they are forced between accepting a vaccine or termination.

IFA has conducted a regular prayer call on Tuesday and Saturday evenings to End Vaccine Mandates that impact over 100 million employees and their employers.  In addition, millions of Americans have been praying to be free of the tyranny of mandates. We have learned something crucial during this time. The Executive Branch wields great power to coerce millions of Americans into an “experimental use authorization” Covid vaccine or be forced to leave their employment against their will.

The good news is we are seeing our prayers answered as recent court cases have protected federal contractors and federal government workers. Another case is pending to protect over 27,000 military service members who thus far have refused a vaccine and are at risk of being discharged from the military.

Military service members seeking relief from vaccine mandates are counting on the case, Navy SEAL 1 v. Biden, in which Florida federal judge Steven Merryday ordered each branch of the military to file a detailed report regarding the number of religious exemptions each branch of the military grants every 14 days beginning with Friday, January 7, 2022.

The filings received by the court last week show that out of 21,342 requests received, zero exemptions have been granted, and many have been denied at the final appeal stage. The reports confirm Liberty Counsel’s argument that the religious exemptions are a ruse and every request will be denied.

This case should not be confused with a recent successful challenge to military vaccine mandates under a similar title, Navy Seal v. Biden, which was decided in favor of 35 service members including members of the Navy Seals, to protect their individual rights to religious exemption from vaccination. This case protects 35 service members, whereby Navy Seal 1 v. Biden seeks a class action ruling for all service members.  

Federal contractors were granted a restraining order from forced vaccinations on December 7, 2021.  On that day, Judge R. Stan Baker from the U.S. District Court for the Southern District of Georgia (in the case titled, THE STATE OF GEORGIA, et al., Plaintiffs, v. JOSEPH R. BIDEN) issued a nationwide injunction of the Biden Administration’s vaccine mandate for federal contractors.  This mandate was originally issued on September 9, 2021, through Executive Order 14042 (EO 14042). This impacts millions of employees who are employed by thousands of  federal contractors.

Federal government workers were granted a key decision protecting their religious exemption rights in the case of Church v. Biden. Judge Colleen Kollar-Kotelly in this case rendered a court order that, “Agencies may not initiate the (vaccine) enforcement process for employees who have not received an exemption or form whom the agency is not considering an exemption request.” Plaintiffs seeking an exemption from receiving any COVID-19 vaccine due to a sincerely held religious belief will not lose their jobs while their request is pending.
