The head judge of the Foreign Intelligence Surveillance Court (FISA) criticized the FBI over its surveillance-application process and told the bureau that it has until Jan. 10 to come up with a solution after Justice Department Inspector GeneralĀ Michael HorowitzĀ detailed significant errors when the FBI placed Trump campaign aide Carter Page under surveillance.

ā€œThe FBIā€™s handling of the Carter Page applications, as portrayed in the [Inspector Generalā€™s] report, was antithetical to the heightened duty of candor described above. The frequency with which representations made by FBI personnel turned out to be unsupported or contradicted by information in their possession, and with which they withheld information detrimental to their case, calls into question whether information contained in other FBI applications is reliable,ā€ federal Judge Rosemary Collyer wrote inĀ an opinion (pdf)Ā for the court on Tuesday.

The court now ā€œexpects the government to provide complete and accurate information in every filing,ā€ she wrote.

Horowitzā€™s report, released last week, identified at least 17Ā ā€œsignificant inaccuracies and omissionsā€ in the application and renewals for Pageā€™s FISA warrant.

While some media outlets highlighted Horowitzā€™s conclusion that there was no political bias at play during the FBIā€™s launch of the FISA application process to surveil Page, he criticized the FBIā€™s ā€œentire chain of commandā€Ā for fits failures duringĀ Senate Judiciary Committee hearing last week.

Later, Republican Senators pressed Horowitz on the role political bias could have played in the FBIā€™s securing of a FISA warrant to monitor Page.Ā Eventually,Ā Horowitz said he couldnā€™t exactly rule it out. . . .

Senate Judiciary Chairman Lindsey Graham (R-S.C.) lambasted the FBI and Department of Justice over how it used the FISA courts, and heā€”along with other Republican senatorsā€”said changes in the FISA application process are warranted.

Horowitzā€™s report didnā€™t just show ā€œa few irregularities,ā€ he said. ā€œWhat happened here is the system failed. People at the highest level of government took the law in their own hands.ā€ Graham added of the mediaā€™s coverage of Horowitzā€™s investigation: ā€œYou clearly didnā€™t read it. If thatā€™s your takeaway that this thing was lawfully predicated, and thatā€™s the main point, you miss the entire report.ā€

Attorney General William Barr, President Trump, and U.S. Attorney John Durham, who is carrying out a relatedĀ criminal investigation,Ā have disputed Horowitzā€™s assertion there was no political bias or intentional misconduct in the FBIā€™s launch of the investigation.
