The Trump administration has formally erased the Biden administration’s controversial Title IX rewrite from federal regulations, restoring rules issued during President Donald Trump’s first term.

The Department of Education announced Monday that its regulations will once again reflect the 2020 Title IX rule. The move formally removes the Biden-era regulations that expanded Title IX protections to include sexual orientation and gender identity and returns federal policy to recognizing sex as male or female at birth.

The 2024 rules also forced schools to use transgender students’ pronouns and changed how schools handle harassment complaints. A federal court struck down the rules in January 2025.

The Education Department then told schools it would enforce the 2020 rules. Monday’s action puts that change into the published federal regulations; schools have already been operating under the earlier rules.

The department said the last lawsuits over the Biden rules were dismissed in August, clearing the way for it to formally remove them. Education Secretary Linda McMahon said the move would make the written regulations match the court rulings and the rules her department has been enforcing since Trump returned to office …

Monday’s action completes a process that effectively began in January 2025, when a federal court struck down the Biden administration’s 2024 Title IX regulations. The Education Department subsequently instructed schools that it would enforce the earlier 2020 regulations instead. With the remaining litigation over the Biden rule dismissed in August, the administration was able to formally remove the 2024 language from federal regulations.

The Biden-era rule had significantly expanded the federal government’s interpretation of sex discrimination in education, extending protections to sexual orientation and gender identity. The regulations also affected schools’ handling of harassment complaints and transgender students. With the 2020 regulations formally restored, the federal government’s Title IX policy will instead recognize sex as male or female at birth.

The regulatory change also follows President Trump’s 2025 executive order directing federal agencies to recognize two sexes, male and female, and to apply that definition when enforcing federal laws prohibiting sex discrimination. Secretary Linda McMahon said the latest action brings the written regulations into alignment with both court decisions and the policies her department has already been enforcing.

For intercessors who have prayed for the protection of women and girls and for biological truth to be recognized in federal policy, this formal change is significant. It not only removes the Biden administration’s Title IX rewrite from the books but establishes the Trump administration’s interpretation in the published regulations schools consult when determining their responsibilities under federal law.
