A new federal lawsuit is challenging a Maryland school district’s policy on student gender identity, adding to a growing national debate over parental rights and transparency in public education. The case centers on allegations that school officials socially transitioned a student at school without informing her parents and then refused to comply with their requests after the parents learned what had happened.

The lawsuit comes as courts and policymakers continue to examine the balance between school policies, parental authority, and students’ rights. The outcome could have implications for similar policies in school districts across the country.

America First Legal (AFL) is leading the lawsuit on behalf of anonymous parents identified as John and Jane Doe. The plaintiffs argue Anne Arundel County Public Schools’ policies violate their First and 14th Amendment rights, as well as similar provisions of the Maryland Constitution. The lawsuit was filed Wednesday in the U.S. District Court for the District of Maryland.

The lawsuit is part of a growing wave of legal challenges targeting school districts with policies allowing staff to withhold information about a student’s gender identity from parents. It also comes months after the U.S. Supreme Court’s decision in Mirabelli v. Bonta, which America First Legal says reinforced parents’ constitutional rights over decisions involving their children.

According to the complaint, the dispute began in December 2025 after a teacher accidentally emailed the parents using a male name for their daughter before attempting to recall the message and later claiming it had been sent to the wrong recipient. The lawsuit alleges the teacher later admitted the explanation was false and acknowledged the student had requested to be called by a male name. The parents then instructed school officials to use only their daughter’s legal name and requested records related to the school’s actions.

According to the lawsuit, school administrators declined the parents’ requests and cited district policies requiring staff to use a student’s preferred name and pronouns while keeping information about a student’s gender identity confidential from parents in certain circumstances. The plaintiffs contend those policies violate their constitutional rights, while America First Legal argues recent court decisions reinforce the authority of parents to direct the upbringing of their children.

The legal challenge is one of several filed by America First Legal involving school policies on gender identity. The organization recently filed a similar lawsuit against Fairfax County Public Schools in Virginia and is pursuing related cases in Pennsylvania and before the Ninth Circuit Court of Appeals. Those cases remain in various stages of litigation.

The dispute also comes as the Trump administration has increased scrutiny of school policies involving parental notification. Earlier this year, the U.S. Department of Education concluded that the California Department of Education’s policies conflict with the Family Educational Rights and Privacy Act by discouraging disclosure of certain information to parents. California has disputed those findings, and related legal challenges remain ongoing. Meanwhile, Anne Arundel County Public Schools declined to comment on the Maryland lawsuit.

The relationship between parents and their children’s schools has become one of the defining public policy issues of recent years. Scripture teaches that parents bear primary responsibility for raising and instructing their children. As courts consider these constitutional questions, let’s pray for wisdom for judges, integrity from public officials, and policies that protect both parental rights and the dignity of every student while promoting truth and accountability.
