Twitter is asking a federal court in Florida to dismiss a lawsuit filed by a child sex trafficking victim, who alleged that the social media giant refused to immediately remove explicit content depicting the child on its platform.

The lawsuit, filed in January, is accusing the Silicon Valley company of knowingly benefiting financially from the dissemination of sexual abuse material when it failed to immediately act on multiple complaints and correspondences asking it to remove the illegal and hurtful content.

The content was eventually removed about nine days after the child and his family made complaints to Twitter. The family and the child victim alleges that Twitter only took action after a Department of Homeland Security agent issued a “take-down demand” against the company when other methods to get the company to remove the content failed, according to the complaint.

“Twitter is not a passive, inactive, intermediary in the distribution of this harmful material; rather, Twitter has adopted an active role in the dissemination and knowing promotion and distribution of this harmful material,” the lawsuit states. . . .

The lawsuit also claims that Twitter failed in its duty to report child sexual abuse material, and was negligent when it failed to take action, allowing the content to be viewed over 167,000 times and re-tweeted 2,200 times before it was taken down. . . .

In a court filing on Wednesday, Twitter did not address allegations that it had “refused” to immediately remove the content after the complaints were made. Instead, it sought to characterize its actions as tardiness in removing the offensive content. The company defended the delay by arguing that the “sheer volume” of Tweets that are posted on the platform renders it “simply not possible for Twitter … to remove all offending content immediately or accurately in all cases.” The company says hundreds of millions of Tweets are posted on the platform every day.

“The fact that nine days transpired before the offending content was taken down does not make Twitter liable under any applicable law,” Twitter states in its motion to dismiss.

The company is also invoking immunity under section 230 of the Communications Decency Act. . . .

“Given that Twitter’s alleged liability here rests on its failure to remove content from its platform, dismissal of the Complaint with prejudice is warranted on this ground alone,” Twitter argued.

They also argue that Congress’s exception to section 230 that permits civil liability claims for online platforms that knowingly participate in a sex trafficking venture does not apply. . . .

The social media behemoth has also argued that the plaintiffs have failed to state a claim to some of the allegations made in the complaint.

According to the lawsuit, Twitter had sent the child an email on Jan. 28 that stated it had “reviewed the content, and didn’t find a violation of our policies, so no action will be taken at this time.” The child had first made a complaint to Twitter on Jan. 21. The content was removed on or about Jan. 30. . . .

The lawsuit against Twitter is seeking to block the platform from continuing to benefit from the illegal content posted on its site, as well as claim damages for the harm caused to the child.

A hearing for the motion to dismiss has been set for June 4. . . .

I pray that this child, the family and any like them harmed by Twitter and the owners and complicit employees will own Twitter and subsequently shut it down. The twitter argument is full of holes…they were quick to shut down the real president and other conservative voices. Evil Pure evil.

We may be wondering what our role is regarding Section 230. We most certainly must pray continually. We need God’s intervention and help for this to change.
But there is something that we can and must do. And it’s our responsibility to see it through. We must email, call and write our legislators at all levels (state and federal). If you own a computer, you can email them daily and demand they address this issue. Some lawmakers will respond to “nice requests” but some won’t – period. So we must be firm in this issue being addressed because it IS a serious issue of corporations “monopolizing” power and control over the 1st amendment, which we now see is having an adverse effect in multiple areas of everyone’s life… like the above family’s situation.
Without our actions, this will continue.

Lord, please use this case to lead people to know that their actions are accountable to You. May people come to know that You are Lord and Sovereign over them. May they fear your judgment and not rely on their popularity or money to continue to do evil. It is Your desire, Lord, that all come to know You as Savior and Lord. Please use this lawsuit to bring about Your justice. I pray in Jesus’ name. Amen.

Let your Congressmen and women know that Big Tech’s “protection (230) needs to be repealed! Section 230 should not be allowed to stand! Big Tech should be held legally accountable, just like other businesses are!! I can’t think of another “business,” in the world that does as much harm as Big Tech!! If voters pray, and then call and let their voices be heard, things will change. Everything they are getting by with now is unconstitutional! Congress needs to make them liable and 230 needs to go!

“Why do You stand afar off, O LORD? Why do You hide Yourself in times of trouble? In pride the wicked hotly pursue the afflicted; Let them be caught in the plots which they have devised. For the wicked boasts of his heart’s desire, And the greedy man curses and spurns the LORD. The wicked, in the haughtiness of his countenance, does not seek Him. All his thoughts are, “There is no God.” His ways prosper at all times; Your judgments are on high, out of his sight; As for all his adversaries, he snorts at them. He says to himself, “I will not be moved; Throughout all generations I will not be in adversity.” His mouth is full of curses and deceit and oppression; Under his tongue is mischief and wickedness. He sits in the lurking places of the villages; In the hiding places he kills the innocent; His eyes stealthily watch for the unfortunate. He lurks in a hiding place as a lion in his lair; He lurks to catch the afflicted; He catches the afflicted when he draws him into his net. He crouches, he bows down, And the unfortunate fall by his mighty ones. He says to himself, “God has forgotten; He has hidden His face; He will never see it.” Arise, O LORD; O God, lift up Your hand. Do not forget the afflicted. Why has the wicked spurned God? He has said to himself, “You will not require it. ” You have seen it, for You have beheld mischief and vexation to take it into Your hand. The unfortunate commits himself to You; You have been the helper of the orphan. Break the arm of the wicked and the evildoer, Seek out his wickedness until You find none. The LORD is King forever and ever; Nations have perished from His land. O LORD, You have heard the desire of the humble; You will strengthen their heart, You will incline Your ear To vindicate the orphan and the oppressed, So that man who is of the earth will no longer cause terror.”

Father, I pray this lawsuit will not be dismissed and like the a death knell, heralds the destruction of Twitter. I pray is now time to hold them accountable for their deceptive ways. In Your Word we read,

“Woe to those who call evil good and good evil…Woe to those who are wise in their own eyes and clever in their own sight….as a tongue of fire consumes the straw, and as dry grass shrivels in the flame, so their roots will decay and their blossoms will blow away like dust; for they have rejected the instruction of the LORD of Hosts and despised the word of the Holy One of Israel.”
Father, Let it be so.

I pray as well for the child and family, may they know You and heal. In the Mighty Name of Jesus Christ. Amen

In Jesus Name, Lord, cause behemoth giants to be accountable. I pray Lord, courts will not allow Twitter attorneys to convince the case be “dismissed”. Please hold Twitter accountable. Humble them, Lord. Bring those responsible for being morally irresponsible to repentance. Amen.

I don’t use Twitter (by choice) but I know enough about it that it is and has been a full blown monopoly for much too long (along with other tech giants). Their CEO Dorsey isn’t interested in any sort of moral compass. If you listen to him for any period of time, his “constant justification” of what is allowed vs. what isn’t allowed reeks of “I am god mentality”.
Their (his) lame excuse that there are “too many postings or tweets” and that they simply cannot oversee, properly manage or “catch up” is such a outright lie and falsehood it should make each of us seeth in righteous anger. This is a company that repeatedly takes down postings within “hours” that they deem “offensive, racist, insensitive, etc. – especially when it doesn’t agree with their CEO’s left leaning or “internal policy that targets those they don’t like”. They had no problems immediately taking down many conservative, religious, anti-COVID, fact based science or other tweets close to or resembling such. Twitter, like many other Silicone Valley tech giants are drunk 24/7 with power and control and have sold their souls to the highest bidders to conduct business “their way”. The sheer volume of filthy language, improper pictures, reinforced anti-religious rhetoric, etc. on Twitter is unreal. (one does not have to be on the site to see those types of postings / tweets “reposted” in many internet avenues).
When it comes to double standards, tech giants such as Twitter set the bar like no other. FB is right there with them.
In their corporate world of power, control and the ongoing mentality that compromise is fine “because WE set the rules”. They inflict constant damage on people daily and they do NOT CARE. They traffic in lies, fraud and deceit while thumping their chest stating that they are providing a “good service”. They have the ability to provide it but choose not to because in the world of Dorsey, his mindset is “we’re untouchable. My company…my rules. Who cares about the Constitution or who gets hurt”!!
**Lord, in You resides perfect truth, justice, mercy, grace and love. There is none like You Lord. You desire Your creation to abide in You..to know You and obey You. I pray for healing for the individual who has brought this lawsuit. I pray that they will know Your love, mercy and compassion. I pray they will know You intimately and that Your glory will be reflected in their testimony. And I pray for justice for them. I truly pray that You would give them a victory in this lawsuit and that the decision will change / force the way big tech does business. I pray that it will be a powerful decision that will bring about much needed change in our nation regarding Sect. 230. While there are many good things that have happened due to SocMed, we also know there is a great deal of evil that has proliferated due to ungodly actions, policies and abuses hiding under the guise of freedom that must change. The only way that will change is when people’s hearts change and You can do that Lord. Give these victim(s) justice Lord God we pray…amen.

Father, I pray that as you defeated the Anak preople who seem so strong, as in Deuteronomy 9, You break down these organizations that seem so powerful, yet You oh Lord go before and will remove those who are so opposed to You and Your ways! You will fight for us and You will give us strategies that will cause them to adhere to righteousness and justice. Protect the innocent, those who can not or know not how to resist the enemy of our souls. Father, bring truth, bring Your deliverance. We pray in Jesus name.

Father God, These media giants want to patrol people for their own political gains. They refuse to be held responsible for taking away people’s free speech in this nation when opinions don’t line up with the left’s agenda. Meanwhile, they also don’t want to take responsibility for the true evil that is on their platform. Use your righteous wrath to bring justice down on them and others like them. Maybe your Word and laws reign down on this nation and snuff out the evil that is infiltrating public perceptions through these platforms. In Jesus’s name I pray. Amen!
