Supreme Court Justices Clarence Thomas and Samuel A. Alito Jr. appeared to suggest that the court should reconsider the landmark Obergefell v. Hodges decision that made same-sex marriage a constitutional right because it threatens the religious liberty of Americans who believe “marriage is a sacred institution between one man and one woman.”
The justices made the argument in an opinion issued Monday in which the court refused to hear an appeal from former Kentucky county clerk Kim Davis who is being sued for refusing to issue marriage licenses to same-sex couples because of her sincerely held Christian beliefs. Davis, who is a devout Pentecostal Christian, was briefly jailed for her actions.
“This petition implicates important questions about the scope of our decision in Obergefell, but it does not cleanly present them. For that reason, I concur in the denial of certiorari,” Thomas wrote in a statement on the case joined by Alito. . . .
The Supreme Court ruled 5-4 in the Obergefell v. Hodges case in June 2015 that state-level same-sex marriage bans are unconstitutional, and concluded that the 14th Amendment requires states to issue marriage licenses to same-sex couples.
Chief Justice John G. Roberts Jr., Justice Antonin Scalia, who died in 2016, Thomas and Alito, were the four dissenters.
On Monday, Thomas noted that they had predicted that the decision would threaten religious liberty in 2015 and Americans who support traditional marriage as part of their religious belief are now being unfairly treated as “bigots.”
“In Obergefell v. Hodges,…, the Court read a right to same-sex marriage into the Fourteenth Amendment, even though that right is found nowhere in the text. Several Members of the Court noted that the Court’s decision would threaten the religious liberty of the many Americans who believe that marriage is a sacred institution between one man and one woman. If the States had been allowed to resolve this question through legislation, they could have included accommodations for those who hold these religious beliefs,” Thomas said.
“The Court, however, bypassed that democratic process. Worse still, though it briefly acknowledged that those with sincerely held religious objections to same-sex marriage are often ‘decent and honorable,’ id., at 672, the Court went on to suggest that those beliefs espoused a bigoted worldview,” he explained. . . .
Thomas further argued that the Obergefell decision left “those with religious objections in the lurch” and “enables courts and governments to brand religious adherents who believe that marriage is between one man and one woman as bigots, making their religious liberty concerns that much easier to dismiss.”
During his campaign in 2016, then-candidate Donald Trump promised that if he was elected, he would consider, appointing Supreme Court judges willing to overturn the Supreme Court’s decision that legalized same-sex marriage nationwide, arguing the move would unite the country.
“It has been ruled upon, it has been there, if I’m elected I would be very strong on putting certain judges on the bench that I think maybe could change things. They’ve got a long way to go. At some point we have to get back down to business but there is no question about it and most people feel this way,” Trump told “Fox News Sunday” host Chris Wallace at the time.
He explained that he wasn’t happy with the way the Obergefell v. Hodges decision was made and believes the issue of same-sex marriage should have been addressed at the state level and not by the federal government. . . .
Five years ago, Trump’s most recent Supreme Court nominee, Judge Amy Coney Barrett, who is awaiting confirmation by the Senate, and is a member of the closely-knit charismatic and ecumenical Christian group called People of Praise in South Bend, Indiana, signed a public letter expressing agreement with the Catholic Church’s teachings on sexuality and the family.
“We give witness that the Church’s teachings—on the dignity of the human person and the value of human life from conception to natural death; on the meaning of human sexuality, the significance of sexual difference and the complementarity of men and women; on openness to life and the gift of motherhood; and on marriage and family founded on the indissoluble commitment of a man and a woman—provide a sure guide to the Christian life, promote women’s flourishing, and serve to protect the poor and most vulnerable among us,” the letter said.

Through them You created a family. It was in Your order and for Your good pleasure. We pray for Justices Thomas and Alito and desire that they would move forward in accordance with Your will. Give them discernment, peace and wise counsel as they proceed. Bring honor and glory to Your name, LORD now and forevermore! Amen.

I declare the fire of God over that unrighteous ruling and the restoration of Your original plan and blueprint to be reinstated in this United States of America which belongs to Your Son. I pray, Father, that You turn the hearts of the fathers to the children and the hearts of the children to the fathers of faith in You. Everybody is talking about faith but we declare our faith in You, Father, and the father of faith Abraham, Isaac and Jacob from which You found both the nation of Israel and grafted us Christians into that same ancient covenant. Father in heaven, please forgive us, the Body of Christ, for being so complacent back in 2015 when SCOTUS sanctioned same sex marriage as the law of the land. Some Churches spoke out but many remained quiet assured that the Church would never be forced to perform same sex marriages.
Many did not understand that same sex relationships break a primary spiritual law established in Genesis 1-3 where You laid out the plan for Your children who are made in Your image to multiply, replenish the earth, subdue and have dominion (Genesis 1:28). In Genesis. Father God, when Sodom & Gomorrah decided to follow their own definition of relationships, You literally destroyed them for this was never Your plan for others to copy or savor. Down through the years of mankind, some have chosen to follow this lifestyle, but it was never condoned as law by government until USA put their stamp of approval by making it the law of the land. Shortly afterwards, Your creation was further mocked when a transitioned male was honored as Athlete of the Year because he chose to be a woman.
How far have we fallen, Oh Lord, where some accept the homosexual behaviors of friends and family members and do not realize that you did not make them this way. You’ve been clear in your Word about homosexuality and have called it abominable. Now, we have a presidential candidate who has stated that one of the first things he will do is to make sure under the Equal Equality Act that everyone will be forced to honor those who practice such behaviors (Romans 1:32).
Father God, may we repent of our sins and get back on track in honoring your spiritual laws so that we again multiple as Your righteous children and have dominion over this earth till Your Son Jesus returns. Amen.

Father, You said in Your word that we should be fruitful and multiply. Same sex marriages cannot do that. The fruit is in the seed Your created in the man joining with the egg in the woman. Father, I pray where there has been a perversion of the covenant relationship between a man and a woman would be restored in individual marriage relationships as a sign from heaven of Your faithful love given through the shedding of Your Son’s blood – the enduring covenant relationship with humanity to align their minds and hearts with You and what You created to be Your good and Your standard. Help mankind to see how the blatant abuse of our sexuality is causing destruction of the family unit, our physical bodies and annihilating man’s purpose in the earth. Forgive us for overstepping Your wise boundaries and calling it good when it only promotes the enemy’s evil agenda. I pray the justices will look at this again and honor the will of people in many states who fought for their states marriage amendments that were totally disregarded when this decision was made. This radical definition of marriage was the start of many disastrous societal changes that have many more far reaching consequences than we have experienced so far.

Why would this be at the Supreme Court ? That they make the Law that God said Man and Woman is not right?

I believe you are right, June. The Supreme Court should never have taken that case in the first place. But they did and justices that did not rightly interpret the Constitution voted on it.
In same sex marriage, the court made this a law, and the Supreme Court is not the law making part of the the United States government.
Had the writers of the constitution had any thought or in clinking that same sex marriage would ever have been a thought, it would have been addressed in the constitution. Therefore, all the writers are rolling over in their graves in shock. I am also in shock!

I am always concerned when same sex marriage is a possible consideration in the highest court of our land, while I personally have gay friends that I cherish, they also understand that I don’t agree with their choices, for moral reasons. We have discussions about important issues, and don’t always agree; but we do agree conversations about hard issues are important, especially because there are so many things we do agree about. Yes, love and acceptance does not mean we need to agree, but we can step beyond our disagreements. For me, God is the ultimate judge of all things and is the real truth giver. I can still love out loud, support someone and disagree about fundamental issues.

My Book does not cut corners or sugar coat the gospel but lovingly tells this great nation called America Watch Out and Repent. Judgement has already being passed, and it starts with the Church.

Our world as we know it is now in an up roar over the Roe vs Wade and the Obergerfell.v.Hodges case, We as a nation is tipping on the edge of destruction because as believers has sat on the sideline saying nothing as these laws were pass saying I don’t want to get involved but God is holding us accountable for not standing up and saying no that is not the will of God, God created us male and female, that’s the plot of Satan to try copy what God did with the lie that some men are mistakes they are really a woman just in the wrong body that’s a lie straight from Hell God never make a mistake, every one is relying on what they think instead of going to word Of God to see what God has to say about things.I firmly believe a baby has the right to live and that marriage is between man and woman,I vote my beliefs.
Almighty God,
Thank you for the wisdom and foresight of these great men. Thank you for the parents, aunties, uncles, others …..who long ago encouraged them to study hard–unknowingly helping them get to where they are today. May we be THAT PERSON to such a young person today.
We ask that You help us as mere citizens to cling to Your truths without ever becoming prideful or hateful –as we know that even at the family level the devil seeks to divide and conquer.
Praying that You use these justices in a mighty way. We humbly ask that You give them a spirit of courage on this issue, and a sense of timeliness to use the power of their role in ways that honor You.
…..please fill Justices Thomas and Alito with words that are convincing.
