SCOTUS  issued a decision Friday, June 21st, in American Legion v. American Humanist Association, commonly referred to as the Bladensburg Cross case. The decision was 7-2 (but with multiple opinions) and the Court overturned the decision from the 4th Circuit, allowing the cross to remain.

You may recall, at the cert stage, 109 Senators and Members of the House of Representatives joined an amicus brief in support of the Petitioners, urging the Supreme Court to hear the case.  After cert was granted, 84 Senators and Representatives filed another brief with the court, led by Senator Cruz.

Holding:  That the cross originated as a Christian symbol and retains that meaning in many contexts does not change the fact that the symbol took on an added secular meaning when used in World War I memorials.

Not only did the Bladensburg Cross begin with this meaning, but with the passage of time, it has acquired historical importance. It reminds the people of Bladensburg and surrounding areas of the deeds of their predecessors and of the sacrifices they made in a war fought in the name of democracy. As long as it is retained in its original place and form, it speaks as well of the community that erected the monument nearly a century ago and has maintained it ever since. The memorial represents what the relatives, friends, and neighbors of the fallen soldiers felt at the time and how they chose to express their sentiments. And the monument has acquired additional layers of historical meaning in subsequent years. The Cross now stands among memorials to veterans of later wars. It has become part of the community.

The Religion Clauses of the Constitution aim to foster a society in which people of all beliefs can live together harmoniously, and the presence of the Bladensburg Cross on the land where it has stood for so many years is fully consistent with that aim

Even if the original purpose of a monument was infused with religion, the passage of time may obscure that sentiment. As our society becomes more and more religiously diverse, a community may preserve such monuments, symbols, and practices for the sake of their historical significance or their place in a common cultural heritage.

With sufficient time, religiously expressive monuments, symbols, and practices can become embedded features of a community’s landscape and identity. The community may come to value them without necessarily embracing their religious roots.

Background: In the aftermath of World War I, the residents of Prince George County wanted a place where they could mourn and honor their dead. Nearly fifty men from the community had fallen during the conflict. Many of them were buried in France, thousands of miles away from those who remembered them. After multiple rounds of fundraising, a 40-foot “Peace Cross” was erected in tribute. At its base sits a plaque inscribed with the names of each of the men who did not make it home. The seal of the American Legion is also found on the cross, along with four words: “Valor,” “Endurance,” “Courage,” and “Devotion.”

The Peace Cross stood in Bladensburg, Maryland for 90 years without objection, often acting as a staging ground for Veterans Day and Memorial Day celebrations. In 2014, however, the American Humanist Association brought suit claiming that the cross violated the Establishment Clause due to its location on public property and the expenditure of city funds for its upkeep. The Fourth Circuit agreed. Employing the much maligned Lemon Test, a three judge panel held that the cross represented an impermissible endorsement of religion because a reasonable observer would equate the symbol as being inherently Christian. After a majority of the Fourth Circuit voted to deny a rehearing en banc, a petition was filed to the U.S. Supreme Court.

Summary, from National Review:

Alito’s majority opinion offers four considerations why there should be a “strong presumption of constitutionality” in favor of “retaining established, religiously expressive monuments, symbols and practices.” (Slip op. at 16-21.)

First, it may be “especially difficult” to identify the “original purpose or purposes” of monuments, symbols, or practices that “were first established long ago.”

Second, “as time goes by, the purposes associated with an established monument, symbol, or practice often multiply”: a community may preserve such monuments, symbols, and practices “for the sake of their historical significance or their place in a common cultural heritage.”

Third, the message they convey might also change over time. Consider, for example, the messages now conveyed by the Statue of Liberty, Notre Dame Cathedral, or the many cities that bear religious names.

Fourth, “when time’s passage imbues a religiously expressive monument, symbol, or practice with this kind of familiarity and historical significance, removing it may no longer appear neutral” but might instead “strike many as aggressively hostile to religion.”

Dear Lord God Almighty thank You for everything. Thank You for prayer and for Your sacrifice of Your Son on a cross so long ago. Thank You to You Lord for inspiring this community to honor the fallen veterans of their area. May all religious symbols in all public places by treated with respect. I was impressed by Justice Alito’s comment on the time value of long-endured monuments that add strength and purpose to a community, and nation.
We who know better must patiently tolerate those so afraid of the proven power and value of our Judeo-Christian value system, and of course pray for them.

I felt a strong burden from the Lord to pray about this several months ago. Over decades I’ve learned that such burdens represent His call to pray about something He wants to do. Praise Him for the privilege of partnership (in prayer) of helping establish His kingdom here on earth.

Praise God.
We used to have a home not far from here. This is a victory indeed. We need to keep praying for a sweeping momentum to take back the territory we have lost as the church slept for the last 40 years.
Keep praying the prayer points and add more as the Holy Spirit leads you. Pray the scriptures, not your feelings. May the Heart of the Father flow through this great nation and impact the world. We will not implode as a nation, we will overtake territory from the enemy.

I’m thankful to hear that the Peace Cross will remain in place. But I don’t appreciate the reasoning, i.e. “the religious significance has worn off”. Our Founding Fathers would not have agreed with that reasoning. While they did not want to have a particular sect established as a national church, they did understand the need for morality and religion and in fact encouraged Christianity. For example one of the first acts of Congress was to print 20,000 bibles that were distributed to schools for their use with the students. The Northwest Ordinance, which established the Northwest Territory (states like Ohio, Indiana, etc.) stated that religion must be taught in the public schools as a condition of becoming a state.
Our Founding Fathers respected the consciences of all people, so all religions, including the “religion of humanism” aka atheism, would be tolerated. But Christianity was clearly the religion they were in favor of supporting. To understand more of this part of the American Heritage, google Dave Barton.

Thank God for the recent decision, and pray for repentance across our land and a return to living for the Lord.

Thank You Father that Your people prayed and You heard from heaven and You answered, may we never grow weary in well doing. This country was found by people who wanted to be able to have the freedom to worship as they choose. IIChronicles 7:14 “ if my people, who are called by my name, will humble themselves and pray and seek my face and turn from their wicked ways, then will I hear from heaven and will forgive their sin and will heal their land.” I pray that we continue to repent and seek God’s face, that healing and restoration will continue in this great land! A land founded on biblical principals and Your Word, Father, may we continue to stand with one voice, in love and grace, but in the power that only comes from the Holy Spirit, May Your Spirit lead and guide every effort to reestablish a land of righteousness and godliness for Your Name sake. The establishment clause was twisted by our Supreme Court when it sited separation of church and state misinterpreted from a letter written by Thomas Jefferson. Jefferson said there was a wall separating government from the religious affairs of the people. The clause was written to protect the freedom of religious practice from government interference. It protects religion from government rather than government from religion. Most of our founding fathers expressed their religious belief in governmental affairs and prayed before opening sessions in congress. Also Ben Franklin called for prayer to ask God’s assistance to settle the disputes in order to ratify the constitution of the United States. But this stronghold which has prevented our children from Christian influence will only be dissolved through prayer.
Lord we ask in Jesus’ name to reverse the decision of separation of church and state and restore its original intent to protect religious freedom from government interference. Praise be to the Lord!

I praise and thank You, Lord. I believe a line was drawn with common sense and that this decision sets the tone for our country to uphold and respect its multi-cultural foundations. I pray that this case sets back those who hate God and attack our right to express our faith in God. Thank You, Lord, for defending the cross and affirming that our society is based on tolerance of free expression and acceptance of freedom of religion. The Bladensburg Cross stands and continues to testify for Christ to those of us God has graced with a belief in Jesus. I pray that more and more people will come to know and love Jesus. I think God is saying it’s about time we fought back against those who want to take God out of our schools, politics and even our country. We have as might right to defend our beliefs and those of the many who fought to give us that right. We need to stand up and stop being a nation of wimps. Our forefathers must be crying when they look at us. We should be ashamed of what we have allowed to happen because of few evil people.
