It’s no secret that even as President Trump delivers a big win for the American people, he faces tremendous opposition. In a recent roll out of rules, President Trump and Secretary of Education Betsy DeVos set out how K-12 schools, colleges, and universities must respond to reports of sexual harassment and assault under Title IX, which prohibits discrimination in education based on sex. Opposition came immediately–within days of the new ruling eighteen attorneys general, all from democratic states, filed lawsuits against Secretary DeVos and the Department of Education, with the full intent to stop or delay the new ruling until after the November 3rd election. At that time, they believed a democratic president would nullify the ruling. The prospects for the survival of the new rules looked grim, but you prayed!

Each president routinely issues Title IX rulings. One of the most significant Title IX rules, set forth by President Obama, applied to sexual harassment or assault accusations, in which case the bare minimum of proof was required for student discipline, evoking the phrase “the woman is always right.” President Trump’s new rule revoked that rule by assuring due process would be granted every person, male as well as female. (Editor’s note: I really recommend this podcast to understand how the cancel culture is wreaking havoc on rights at universities–https://omny.fm/shows/the-eric-metaxas-show/alec-klein-1).

The eighteen democrat district attorneys filed lawsuits in two different courts. Judge John G. Koeltl presided over the first suit filed in the U. S. District Court for the Southern District of New York. Judge Koeltl was appointed in 1994 by President Clinton. Judge Koeltl said he would not stop the new Title IX rule from taking effect. In his closing remarks, stated, “Rather than harming students, the Rule has the potential to benefit both complainants and respondents by providing procedural guidance for grievance procedures.”

The remaining seventeen democrat district attorneys filed jointly in the U. S. District Court for District of Columbia. Judge Nichols ruled against the injunction and stated, “Although plaintiffs have raised serious arguments about certain aspects of the Rule, they have not established a likelihood of success of their claims, nor have they established that they are likely to suffer substantial irreparable harm pending further litigation.” Judge Nichols, appointed by President Trump, has served since 2019.

On August 14, Secretary DeVos issued a press release in which she said, “Today marks a new era in the storied history of Title IX in which the right to equal access to education required by law is truly protected for all students. Every student should know that their school will be held accountable for responding to incidents of sexual misconduct and that it must treat all students fairly. This rule, as courts have recently noted, restores balance to the scales of justice in our schools, ending one of the most infamous and damaging overreaches of the previous administration.”

An article published by Intercessors for America on May 19, 2020, Trump Admin Delivers A Big Win For Students gave intercessors the information, and you took it to the Lord in prayer, now every student has the right to due process when accused of sexual harassment. Thank you for your prayers!
