Former CIA Director John Brennan must testify under oath about his role in a grand conspiracy to frame President Donald Trump as a Russian puppet, according to a new legal filing.

Brennan will be compelled by a subpoena to testify on Oct. 15, 2026, before a federal grand jury sitting in Fort Pierce in Southern Florida, the legal filing shows..

The filing reveals the Justice Department (DOJ) is pursuing two probes, including a far-reaching conspiracy investigation to include “issues at Mar-a-Lago and beyond,” an apparent reference to the 2022 FBI raid of Mar-a-Lago over classified records, and another narrower one related to Brennan’s sworn statements before Congress.

The subpoena surfaced through Brennan’s own attorney. Ken Wainstein disclosed it in a filing connected to Brennan’s lawsuit against the Justice Department, in which Brennan accuses the department of violating his constitutional rights while pursuing what he calls “phantom criminal conduct.” Wainstein, reached through his law firm, declined to comment.

The document carries a notable signature. It was signed on Sept. 9, 2026, by Joseph E. diGenova, then counselor to the attorney general, who abruptly resigned as the top prosecutor on the Russiagate conspiracy case the following day. Brennan’s filing quotes diGenova’s remarks to the New York Post that “if you want indictments where there’s no evidence, you have an ethical problem,” along with his later comments to the Associated Press insisting there is evidence of criminal behavior but a dispute over pacing. DiGenova said there is plenty of evidence to prove the theories of prosecution, but that reaching the finish line takes time and some people want to move faster than the law allows.

DiGenova had taken charge of the case in April 2026 and was reportedly pursuing broad charges. Anonymous officials told reporters he had fallen down “rabbit holes,” and CNN reported that his requests for a Sensitive Compartmented Information Facility to review highly classified material, plus additional attorneys, created friction with the department.

Investigators face practical obstacles. Some Russiagate documents declassified by the Trump administration had reportedly sat at CIA headquarters in Langley, Virginia, for years, complicating the effort to assemble the classified record. The statute of limitations is another hurdle. The effort to cast Trump’s 2016 victory as the product of a Russian plot began roughly a decade ago, and most federal crimes carry a five-year limit. In a conspiracy case, however, the clock runs from the last overt act taken in furtherance of the scheme, which means a later event, including the 2022 Mar-a-Lago raid, could extend the timeline. At least one witness has been contacted about the raid, according to CNN.

The case is being led by Jason A. Reding Quiñones, the Trump-appointed U.S. attorney for the Southern District of Florida, and the Fort Pierce courthouse is presided over by U.S. District Judge Aileen Cannon.

Declassified records have sharpened the focus on Brennan’s conduct. According to a House Permanent Select Committee on Intelligence report declassified in July, just five CIA analysts under Brennan wrote the January 2017 Intelligence Community Assessment that launched years of Russiagate speculation, even though the document was technically endorsed by the CIA, FBI, and National Security Agency. Those analysts were drawn from a “Fusion Cell” Brennan had formed months earlier, per a separate CIA self-assessment declassified in July. The small team produced the assessment in less than a week leading up to Christmas, and Brennan withheld the underlying “sensitive intelligence,” described as unverified, slanted, and in some cases irrelevant raw reporting, from other parts of the intelligence community until a compressed two-day review. Brennan also included the Steele dossier, opposition research funded by Democrats, in drafting the assessment.

House Judiciary Committee Chairman Jim Jordan referred Brennan to the Justice Department for criminal prosecution in October 2025, alleging he lied under oath to Congress about the assessment. Jordan said Brennan overruled senior CIA officers who objected to including dossier material, making that call alongside then-FBI Director James Comey.

Brennan has denied wrongdoing and has not been charged. The subpoena compels his testimony, not his indictment.

The integrity of American justice depends on whether the machinery of federal power can be turned against a political opponent and then quietly forgotten. Scripture warns against bearing false witness and against those who “frame mischief by a law” (Psalm 94:20), and it calls rulers to judge rightly rather than weaponize authority for factional ends (Proverbs 29:4). If intelligence officials manufactured or slanted a case against an incoming president, that is not a partisan talking point. It is a grave abuse that undermines public trust in every institution it touches. What matters now is that the truth be established through lawful process and due protection for the accused, whatever the outcome. Intercessors should pray for investigators to pursue facts rather than vendettas, for the innocent to be cleared, and for the guilty, if any, to be held accountable without regard to party. A republic cannot long survive if its law enforcement becomes a tool of its politics.
