DOJ Sues Milwaukee Over ICE Mask Ban, Citing Federal Authority
The Department of Justice is once again defending the federal government’s authority to enforce immigration law, this time by suing the city of Milwaukee over its ban on masked law enforcement officers. The lawsuit argues that the ordinance unlawfully interferes with federal agencies such as U.S. Immigration and Customs Enforcement (ICE) and violates the Constitution’s Supremacy Clause.

According to the DOJ, Milwaukee’s policy is part of a broader pattern among Democrat-controlled cities seeking to obstruct federal immigration enforcement. The department contends that local governments cannot impose restrictions on federal officers carrying out their lawful duties, arguing that federal authority supersedes conflicting municipal regulations.
The lawsuit also raises concerns about the safety of federal agents. The DOJ argues that prohibiting officers from wearing masks makes it easier for far-left activists to identify them, potentially exposing them to harassment and intimidation simply for enforcing federal immigration law. As immigration enforcement has become increasingly contentious, the department maintains that officers should not be forced to choose between doing their jobs and protecting themselves and their families.
In its filing, the Justice Department urged the court to reject Milwaukee’s ordinance, stating, “This Court should join the growing number of others that are putting an end to this type of blatant unconstitutional regulation of the Federal Government.”
The lawsuit follows several similar legal actions brought by the DOJ this year. According to the National Pulse, the department has already succeeded in overturning comparable restrictions in other jurisdictions, including Philadelphia. Earlier this year, the Trump administration also secured a victory when the U.S. Court of Appeals for the Ninth Circuit blocked a California law backed by Governor Gavin Newsom that prohibited federal agents from wearing masks.
Even if courts continue striking down these ordinances, however, the broader conflict between the Trump administration and Democrat-led cities is unlikely to end. The article points to Philadelphia District Attorney Larry Krasner, who referred to ICE agents as “wannabe Nazis” earlier this year while threatening legal action against the agency. If mask bans fail to survive judicial scrutiny, opponents of federal immigration enforcement may simply pursue other avenues to hinder ICE’s work.
The debate also exposes what many conservatives view as a striking double standard. Several of the same Democrat-run cities now seeking to prevent federal officers from concealing their identities were far less concerned when masked Antifa militants roamed their streets during periods of unrest, intimidating communities, attacking police, and damaging property while hiding behind face coverings. Yet federal agents enforcing the nation’s immigration laws are now being told they cannot take similar measures to protect themselves from harassment and retaliation.
Ultimately, the case is about more than masks. It is another test of whether local governments can impede the work of federal law enforcement based on political disagreement. A ruling in favor of the DOJ would reinforce the principle that cities cannot override the constitutional authority of the federal government simply because they oppose its immigration policies.
