In a landmark jury award that is sending shock waves through the transgender and medical communities, a jury in White Plains, New York, found a psychologist and a surgeon guilty of malpractice and awarded $2 million in damages to a young detransitioner.

Fox Varian, now 22 years old, sued her surgeon, Dr. Simon Chin, and her psychologist, Kenneth Eihiorn, for removing her healthy breasts at 16 years old and disfiguring her for life. At the time, she identified as a transgender male.
When she saw her mutilated chest, Miss Varian instantly regretted her decision and knew it was wrong. In 2023, she sued her doctors, claiming they did not follow the standards of care for transitioning.
Pressured into Transitioning
Fox Varian exhibited many of the high-risk characteristics of confused youngsters who turn to gender dysphoria as a way out of their mental misery. She was depressed, anxious, and autistic. She suffered from body image issues and was anorexic.
At 15, she began seeing a psychologist, Kenneth Einhorn. She soon began questioning her gender. She said she “felt lost” and felt “pressure” to identify as male. On Einhorn’s advice, she began socially transitioning. She cut her hair, wore boys’ clothes, bound her breasts, and changed her name.
Einhorn sent her to an LGBTQ center, where Miss Varian expressed doubts about her gender. In her gender confusion, Miss Varian did request the surgery but expressed at trial that it was her psychologist who “drove the train” for her to have a double mastectomy. According to her lawyer’s opening statement, it was Einhorn who had been “putting ideas into her head” to change her sex with surgery.
Einhorn wrote a brief referral letter to her surgeon, Dr. Chin, recommending the surgery. But in the letter, he failed to mention that Miss Varian also suffered from depression and anorexia. At trial, he did admit that he also failed to read the notes from Miss Valerian’s sessions at the LGBTQ Center, expressing her doubts about her gender.
Dr. Chin met with Miss Valerian only twice for a total of one hour prior to surgery. He also admitted at trial that he would not have performed the surgery had he known about Miss Varian’s doubts. The “standard of care” is that a patient cannot have surgery until their gender identity has been “stable” for six months. (That’s frightening in itself.)
Miss Varian’s surgery occurred within four months after expressing her doubts about her gender. Dr. Chin performed her surgery only nine weeks after their first meeting.
At Trial
At trial, Miss Varian testified, “I was 16. And I was really, really mentally ill, obviously. I wasn’t mature enough to make the decision to have surgery. And I certainly wasn’t mature enough to handle the aftermath.”
Miss Varian’s mother testified that she was against the surgery. But like many parents of transgender children, she was told by the psychologist that if she didn’t consent, her daughter would commit suicide. There is no empirical evidence to support this lie. In fact, research shows that those who transition are 19 times more likely to commit suicide than the general population.
After surgery, Miss Varian continued to struggle with depression and mental health issues. Like many detransitioners, she quickly realized that transitioning solved none of her mental health issues. She also expressed to her psychologist post-surgery that she was having suicidal thoughts and had begun cutting herself.
Adam Deutsch, Varian’s lawyer, argued that these medical professionals abandoned all guardrails.
“They had every opportunity to slow this down, to do the work, to follow the standards, to say ‘Not yet,’ to ask questions, to explore,” Deutsch said. “And instead, they did nothing. They abandoned all of the guardrails and then tried to sell to you that no guardrails exist. And a vulnerable child paid the price.”
A Landmark Decision
It’s important to note that the six-member jury was not asked to decide if transgender surgeries are appropriate for minors. Their decision relied on whether the two doctors took the appropriate steps before surgery to assess Miss Varian’s gender diagnosis correctly.
In the first detransitioner’s lawsuit to reach a verdict, the jury ruled they did not follow the appropriate standard of care.
Miss Varian’s case is a breakthrough for justice for these kids who are rushed through a transitioning process with very little to no psychological assessment. It can be less than a year from when a young person says, ‘I think I’m a girl or boy,’ to surgical transitioning.
Sadly, our medical profession is caught up in offering treatments and procedures based on ideology and not biology or scientific-backed evidence. So-called medical professionals do not even ask whether children can really understand what these life-altering medical procedures will mean for their futures. The professionals in this case did not even share the risks with Miss Varian associated with removing her healthy breasts.
Miss Varian’s lawyer, Adam Deutsch, told The New York Post, “Knowing now that a jury will feel comfortable holding doctors accountable for this is something that I think every doctor should take seriously.”
More Detransitioners Suing
Perhaps there is no more powerful voice rising in this country exposing the truth of the physical and mental damage of false transitioning to another sex than the voices of detransitioners.
Currently, there are 28 similar malpractice lawsuits by detransitioners against doctors, psychologists, hospitals, and insurance companies. Hopefully, Miss Varian’s win will open the floodgates for more lawsuits, as there are thousands of detransitioners whose stories and sufferings are ignored by the legacy media and the medical establishment.
One of those lawsuits is by high-profile detransitioner advocate Chole Cole, who also had a double mastectomy in her early teens.
“My teenage life has been the culmination of excruciating pain, regret, and most importantly, injustice,” Miss Cole said. “I have been emotionally and physically damaged and stunted by so-called medical professionals in my most important developmental period. I was butchered by an institution that we trust more than anything else in our lives.”
On Fox News, Miss Cole said in reaction to the jury’s decision, “I think that $2 million is not nearly enough to compensate for the damages that these doctors have done to my generation. I think that it would only be right if every single doctor and clinic involved in this has their wallets completely drained, and they’re all thrown in prison with the keys thrown out.”
Trump Administration Prioritizes Protecting Children
President Trump and his administration are doing everything in their power to halt sex-rejecting treatments on minors.
Among the president’s first Executive Orders was one proclaiming that the U.S. government recognizes only two sexes – male and female. Another EO restricted access to sex-rejecting treatments for minors younger than 19.
In April 2025, Dr. Mehmet Oz, Director of the Centers for Medicare and Medicaid Services (CMS), issued a statement saying, “Medicaid dollars are not to be used for gender reassignment surgeries or hormone treatments in minors—procedures that can cause permanent, irreversible harm, including sterilization,” he continued. “We have a duty to ensure medical care is lawful, necessary, and truly in the best interests of patients.”
In May of 2025, after a comprehensive review, the U.S. Department of Health and Human Services (HHS) declared very weak evidence to support transgender treatments. When releasing their review, HHS stated…. “Despite increasing pressure to promote these drastic medical interventions for our nation’s youth, the review makes clear: the science and evidence do not support their use, and the risks cannot be ignored”.
In December 2025, HHS stated, “sex-rejecting procedures on children — which include puberty blockers, cross-sex hormones, and surgical operations — expose them to irreversible damage, including infertility, impaired sexual function, diminished bone density, altered brain development, and other irreversible physiological effects.”
HHS Secretary Robert F. Kennedy, Jr. signed a declaration, finding that these procedures do not meet professionally recognized standards of health care. Under the declaration, practitioners who perform sex-rejecting procedures on minors would be deemed out of compliance with those standards.
CMS Director, Dr. Mehmet Oz, issued a notice barring hospitals from performing sex-rejecting procedures on children under age 18 as a condition of participation in Medicare and Medicaid programs. The same rule would apply to federal Children’s Health Insurance Program (CHIP) funding.
The U.S. Food and Drug Administration (FDA) issued warning letters to 12 manufacturers and retailers for illegal marketing of breast binders to children.
Twenty-seven states currently ban any form of transition-related care on minors, and a growing number of hospitals are opting out of providing sex-rejecting care.
Now, with a breakthrough in the first jury willing to award substantial damages to detransitioners, are we seeing the beginning of the end to mutilating and sterilizing children in the cause of this demonic transgender ideology? Let’s pray so.
Are the Dominoes Falling?
In prior IFA articles on transgender issues, I have asked for prayer that the detransitioners’ voices are heard.
I have also asked for prayer for detransitioners to have the courage to file medical malpractice lawsuits that could lead to huge payouts to injured payments. When insurance companies are paying out huge damage awards to injured patients, they’ll stop insuring doctors, hospitals, and other medical professionals who support and perform transgender care.
Miss Varian’s voice was heard by a jury in deep blue New York, and they agreed with her, awarding her $2 million. What an answer to prayer. Glory be to God. Thank you, intercessors, for your prayers.
This award most certainly will put a chill into hospitals, doctors, and psychologists to be more cautious in rushing towards advocating for transgender treatments, including surgeries. Insurance companies are not going to want to be on the hook for more and bigger payouts.
Let’s pray that insurance companies hike their malpractice insurance premiums after this legal victory, so doctors and other medical professionals can no longer afford to carry it for any sort of transitioning treatments – physical and psychological.
Let’s pray they stop offering malpractice insurance altogether for any sort of sex-rejecting trans treatments.
Let’s pray insurance companies start demanding that hospitals and medical professionals stop offering trans treatments.
Let’s pray that insurance companies refuse to cover trans treatments.
Let’s pray for legislators in the 18 states and D.C. to overturn their laws requiring insurance companies to provide sex-rejecting treatments of any kind.
Is the Transgender Madness Finally Collapsing?
Today, so-called gender-affirming care is promoted by supposedly learned people, experts, doctors, therapists, and psychiatrists. For instance, the American Psychological Association, the American Medical Association, and the Endocrine Society promote transgender treatments for minors, denounce child protection laws, and urge insurance companies to cover these treatments. The American Academy of Pediatrics says transgender care is vital and reduces the risk of suicide.
Shortly after the jury’s verdict was announced, the American Society of Plastic Surgeons issued a position statement advising against sex change surgeries for minors, becoming the first medical association to do so.
Let’s pray that more medical associations will see the weakness of the scientific evidence that supports their current positions on transgender care and take steps to reverse their positions and restore the public’s trust in medicine.
In September 2025, Republican senators introduced the Chloe Cole Act that would ban the chemical and surgical mutilation of children and provide detransitioners whose healthy body parts have been damaged by these procedures with legal recourse. The Act would also declare sex as a biological fact, now a political label.
Let’s pray this Act is passed into law, ending this medical malpractice in every state.
Dear Heavenly Father, we thank You that You are sovereign and You are demolishing the evil transgender ideology that is attacking our young people. We pray that this jury verdict will change hearts and minds among the medical community, media, and activists, to end these harmful, permanent treatments that are destroying the lives and health of our children.
We pray that this jury decision gives hope to those who are suffering from the malpractice of doctors and psychologists and emboldens them to file lawsuits. Give justice to those who are seeking through the courts to hold the evildoers accountable.
Lord, we ask for Your protection, love, and mercy to fall upon every child and their parents who are suffering through this demonic deception. Grant them wisdom and discernment not to fall for the lies but to seek Your counsel and refuge. Heal them from all physical and emotional harm from the damage inflicted upon them by misguided and untruthful experts.
Help us, Lord, to fight on, speak out, and pray boldly until total victory is won. We pray for more voices to proclaim the dangers of transgender ideology and that truth will prevail. We pray for the medical community to seek Your will and speak out in love against this evil.
Be strong and courageous. Do not be afraid or terrified because of them, for the Lord your God goes with you; he will never leave you nor forsake you (Deuteronomy 31:6).
We demolish arguments and every pretension that sets itself up against the knowledge of God, and we take captive every thought to make it obedient to Christ (2 Corinthians 10:5).
