Trump Asks SCOTUS to Rule on Birthright Citizenship, Federal Firings
Next week, the Supreme Court will begin a new term, hearing an assortment of cases and untangling some of the nation’s most difficult legal problems. At the top of the agenda is President Trump, who’s calling on the high court to rule on whether he has the authority to end birthright citizenship.
Have you taken your place on the wall?
From Reuters:
President Donald Trump‘s administration asked the Supreme Court on Friday to review the legality of his bid to limit birthright citizenship in the United States, teeing up a major test of one of his most contentious policies that could alter how the U.S. Constitution has long been understood on the subject.
The Justice Department filed two appeals of lower court rulings that blocked Trump’s executive order, which the Republican president signed on his first day back in office in January as a key part of his hardline approach toward immigration.
“The lower court’s decisions invalidated a policy of prime importance to the President and his Administration in a manner that undermines our border security. Those decisions confer, without lawful justification, the privilege of American citizenship on hundreds of thousands of unqualified people,” the Justice Department wrote in the appeals.
Reuters notes the Supreme Court’s next term begins on Monday, October 6. The court hasn’t yet responded to the President’s plea, but it may do so closer to the start of the new term.
Intercessors may remember that the high court already weighed in on the President’s birthright citizenship order in June, though that ruling didn’t fully answer the question. The Supreme Court at the time chose not to address the underlying issue of birthright citizenship and President Trump’s executive order, choosing instead to limit the ability of judges to issue universal injunctions.
While the Supreme Court’s ruling is an answer to our prayers, it didn’t end the debate over birthright citizenship. While judges no longer have to authority to block the nationwide implementation of this order, some have still blocked it from applying to certain states and individuals.
But this case isn’t the only issue facing the Trump administration that the Supreme Court may weigh in on. According to Fox News, the court is also poised to determine whether the President has the authority to fire certain federal employees.
From Fox News:
The Supreme Court is set to reexamine a landmark decision about the president’s ability to fire members of independent agencies, and the outcome could expand executive power and have far-reaching implications.
The high court revealed in an order last week it would revisit Humphrey’s Executor v. United States, a 1935 decision that Hans von Spakovsky, a legal fellow at the conservative Heritage Foundation, said is now on “life support.”
…
The Supreme Court’s decision came in response to a challenge from a Biden-appointed FTC commissioner whom President Donald Trump fired at will after taking office.
The Supreme Court previously issued a 6-3 emergency ruling in this case, ruling that Rebecca Slaughter, the commissioner in question, would remain fired while legal proceedings continue. Now, the high court is poised to settle the issue once and for all by taking on Humphrey’s Executor, a legal precedent that protects employees at independent agencies like slaughter from being fired without due cause.
Fox notes that the Supreme Court’s ruling here could have far-reaching implications. President Trump has been stopped from firing federal employees across different agencies several times now. If the Court rules in his favor, it could clear the way for a total reshaping of the federal government.
As the Supreme Court prepares to once again weigh in on President Trump’s actions, let’s pray for wisdom and boldness for every justice!
