(The Center Square) – A federal judge Thursday ordered an indefinite stop to the Trump administration’s efforts to dismantle the U.S. Department of Education.
The court order reinstated 1,300 fired workers, nearly half the department’s staff, and blocked attempts to transfer management of federal student loans and special education functions out of the department.
The U.S. District Court for Massachusetts granted a preliminary injunction in the case, which combined two previous lawsuits. One was Somerville Public Schools, et al v. President Donald Trump, et al. The other was State of New York, et. al, v. Secretary of State Linda McMahon, et al, and was filed by a coalition of states including California, Arizona, Colorado, Nevada and Washington state.
Preliminary injunctions remain in effect until a court says otherwise.
Plaintiffs argued the Trump administration’s attacks on the Department of Education are illegal and unconstitutional.
Judge Myong Joun, who was appointed by President Joe Biden, agreed Trump needs congressional approval to dismantle the department. He also said plaintiffs will be harmed irreparably unless the cuts were frozen.
“I am convinced that the asserted harm to Plaintiff States’ citizenry, particularly their student populations, constitutes irreparable injury to Plaintiff States for purposes of the preliminary injunction,” the Boston judge wrote in his 88-page decision.
Joun noted plaintiff states and school districts are experiencing delays and uncertainty in receiving millions of dollars in federal funds, “which jeopardize their missions of ensuring an educated citizenry and providing quality education. Such delays and uncertainty raise immediate predicaments about whether there will be sufficient staff and student programming for the 2025-2026 school year and hinder long term planning.”
There could be irreparable harm to students’ education, Joun said.
The judge also noted the defendants have acknowledged they can’t close a federal department without congressional approval.
There’s no evidence that the defendants are working with Congress, Joun said.
Trump issued an executive order March 20 ordering McMahon to take all necessary steps to shut down the Department of Education.
“Closing the Department of Education would provide children and their families the opportunity to escape a system that is failing them,” Trump wrote in his order. “Today, American reading and math scores are near historical lows.”
The president’s order led to the firing of more than 1,300 workers, almost half of the department’s staff.
Joun noted Trump’s executive order said the department is only to be closed to the maximum extent allowed under the law.
That’s in Section 2 of the executive order.
Arizona Attorney General Kris Mayes Thursday said the Trump administration has “zero authority” to dismantle congressionally authorized agencies.
“I’m proud to have brought this lawsuit to protect the funding and services that so many schools across Arizona – particularly in rural parts of the state – rely on,” Mayes said Thursday in a news release. “We will keep fighting to ensure the President follows the law.”
The layoffs ordered by Trump have hurt the Department of Education’s ability to meet statutory obligations for various programs such as student aid, civil rights enforcement and vocational training, according to the California Attorney General’s Office.
“We will continue to fight to ensure the unlawful and absurd dismantling of the Department of Education is reversed — permanently,” Attorney General Rob Bonta said in a statement. “Our students deserve better.”

The federal Dept. of Education has done absolutely no good to the education of US children. The US has some of the worst math and reading scores of all developed countries. I believe that state and local control of education for America’s students would be a better use of the funding provided rather than the federal government which is mired in wasteful spending.
Yes, our students do deserve better., but are they receiving the best education or are they being trained in the ideology of a teacher or school system. Lets get back to reading, writing and arithmetic. Let children form their own opinions about what they believe as they develop their minds. We are not doing them a service, but are controlling their thinking process. Is this a free country?

A.G. Bonta is correct, but incorrect. He asserts that what is ‘better’ is to retain the Dept. of Ed. I contend that what is better is to dismantle it. I agree with President Trump – “Closing the Department of Education would provide children and their families the opportunity to escape a system that is failing them.” It is so easy to establish bureaucracy, but so hard to dismantle it.

From WHERE do these liberal judges think that they have the right to shoot down legislative action by the POTUS? Personally I think that this is unacceptable. Our Supreme Court needs to be proactive in protecting the actions of the legislative branch of our government in each and every situation that involves the inappropriate actions of these “judges.” Lord Jesus, You see the evil that is occurring in our national government. The answer to your opening question is n the wording of your question. POTUS cannot write legislation, only enforce it. The process of dismantling must come through the legislative branch, Congress. Senator Mike Rounds, SD has re-introduced legislation in the Senate that clearly sets the process and methods of shutting down the DOE. He introduced it a couple years ago, but it never made it to the floor. Right now, it is stalled in committee. The bill is titled:Returning Education to Our States Act”
I suggest people call their senators and encourage them to join Sen. Rounds to get legislation to dismantle the DOE started in Congress.
As we have seen, executive orders can be undone by future administrations. We need congressional action to put EOs into statutes, laws.

Before 1979, there was no department of education. There has been a steady decline in morality and education as schools from elementary to university have, in many cases, become indoctrination camps in many ways. That is a direct result of the federal department of education. It has stolen much of the God-given power of parents having a say in their children’s education. We thank you Lord that you are restoring that. We curse and dismantle preemptively all of the Lawfare that is currently going on against the dismantling of the Department of Education and we thank you Lord that you are returning the power of choice to the parents of the children to do as they see fit for those children.

I say cut this judge and all the other demonic driven judges salaries. The federal government cannot continue to spend money it doesn’t have and no judge can force the president to do so. These judges should recuse themselves on basis that most if not all have Trump Derangement Syndrome. Public school (from national to local levels) has somehow been politicized, weaponized and demonized into becoming a platform for sexual explicitness, extreme liberal exhibition and forums to promote narcissism – all without authentically proven “educational” success being demonstrated by, not the “test scores” which can be skewed in either direction, but the production of competent, able bodied, and confidant individuals who are proud of the nation in which they live and who are willing to be its productive, loyal, and successful citizens. My God! Where has integrity, decency and sanity gone?!
